FINAL REVISIONS TO THE KENTUCKY REGULATIONS
Dear Russell Hestand:
We have reviewed the final revisions to the Kentucky regulations Sections 902 KAR 100:050, 058, 065, 165, 185, 195, and 200, received by our office on February 27, 2024. These regulations were reviewed by comparison to the equivalent U.S. Nuclear Regulatory Commission (NRC) rules in 10 CFR 19, 20, 31, 32, 36, 70, and 150 as identified in the enclosed State Regulation Status (SRS) Data Sheet. We discussed our review of the regulations with you on September 18, 2024.
As a result of our review, we have 19 compatibility comments and eight editorial comments that have been identified in Enclosure 1. The second compatibility comment concerns an issue we recently identified where the 10 CFR Parts 19 and 20 review summary sheets were not updated to incorporate the changes in compatibility from the "Licenses, Certifications, and Approvals for Nuclear Power Plants" (72 FR 49352) (Aug. 28, 2007) rule. This rule designated certain portions of the regulations as compatibility category NRC. To address this, Kentucky must ensure that references to 10 CFR Parts remaining under NRCs regulatory authority (e.g., 10 CFR Parts 50, 52, 54, 60, 63, 72, and 76) are not incorporated by reference.
Please note that we have limited our review to regulations required for compatibility and/or health and safety. We have determined that if these regulations are revised, incorporating our comments, and without other significant change, they would meet the compatibility and health and safety categories established in the Office of Nuclear Material Safety and Safeguards (NMSS) Procedure SA-200, Compatibility Categories and Health and Safety Identification for NRC Regulations and Other Program Elements.
We request that when you revise your regulations to address our comments, a copy of the as published regulations be provided to us for review. As requested in NMSS Procedure SA-201, Review of State Regulatory Requirements, please highlight the final changes and provide a copy to Division of Materials Safety, Security, State, and Tribal Programs, NMSS.

3 902 KAR 100:010, Section 1 and 902 KAR 100:185, Section 2.(1)(a) and (2)(b) 20.1003 N/A Various Definitions Section 2 of 902 KAR 100:185 incorporates all the definitions in 10 C.F.R. 20.1003, with the exception of the definition of licensee. However, 902 KAR 100:010, Section 1 already contains most definitions found in 10 CFR 20.1003. To avoid duplication, Kentucky should not incorporate by reference those terms that Kentucky separately defines in 902 KAR 100:010.
To address this issue, please update 902 KAR 100:185, Section 2.(1)(a) to exclude from adoption 10 C.F.R.
20.1003, except for the definitions for

Upon making the above change, Kentucky can delete the statement in 902 KAR 100:185, Section 2.(2)(b) which states that, reference to the Commission or an agreement state shall be deemed to be a reference to the Cabinet for Health and Family Services, Department for Public Health, Radiation Health Branch, the commission, or an agreement state.
The phrase Commission or Agreement State is only found in the definitions that will not be incorporated by reference after implementing the first portion of this comment.

Definition: Person Kentucky 902 KAR 100:010, Section 1.(200) contains an incorrect reference to the definition for person. The correct reference should be KRS 216B.015(22) instead of (16). The Kentucky definition for person is: Person" means an individual, a trust or estate, a partnership, a corporation, an association, a group, state, or political subdivision or instrumentality including a municipal corporation of a state. This definition does not include, (2) Any legal successor, representative, agent, or agency of the foregoing.
Please amend the definition of Person to make clear that any legal successor, representative, agency, or agency of the listed entities also qualifies as a person under the regulations to meet the compatibility category C assigned to the definition of person.
5 902 KAR 100:010 Section 1.(37) 20.1003 N/A H&S Definition: Byproduct material 902 KAR 100:010 Section 1.(37) defines byproduct material as including sections (1) and (2) of the 10 CFR Part 20 definition of

Kentucky needs to correct the definition to be essentially identical with the definition found in 10 CFR Part 20.
Kentuckys definition for Total Effective Dose Equivalent in 902 KAR 100:010.Section 1.(312) differs from 10 CFR Part 20 by using deep-dose equivalent vice effective dose equivalent for external exposures.

Kentucky needs to change the definition to be essentially identical with the definition found in 10 CFR Part 20.
