Stephen Koenick and I am the Environmental Projects 10 Manager Branch Unit 1
Chief at the Nuclear 11 Regulatory Commission and I'd like to welcome you 12 to our in-person meeting to discuss the draft 13 Environmental Impact Statement related to the North 14 Anna Power Station Units 1 and 2 subsequent license 15 renewal application.
16 Something you will hear -- so I'm at 17 the U.S. Nuclear Regulatory Commission, or NRC.
18 You will hear it referred to during this meeting.
19 I am the senior agency official for 20 this meeting and it's also my pleasure to be the 21 facilitator for today's meeting. And I will do my 22 best to help make this meeting worthwhile for 23 everyone and I hope you'll help us out with that.
24 Now a term you're going to hear a lot 25

Statement documents the NRC staff's analysis of 2
potential impacts of a proposed major federal 3
action on different aspects of the human 4
environment such as land use, air quality, geology 5
and soils, surface and groundwater, terrestrial and 6
aquatic
- ecology, human
- health, environmental 7
justice, postulated accidents, and more.
8 The EIS also documents the staff's 9
evaluation of the alternatives to the proposed 10 action, which in this case is continued operation 11 of the North Anna Power Station for an additional 12 20 years. Today's meeting is just one of the why 13 you can participate in the process, and we'll be 14 going into more detail about that later.
15 Our goals today are to, one, provide an 16 overview of the EIS, of the draft EIS associated 17 with the North Anna subsequent license renewal 18 which was published in the Federal Register; the 19 reference is 89FR960, on January 8th, 2024, for a 20 45-day comment period. The second thing we'd like 21 to discuss is the staff's preliminary 22 recommendation. And finally, we'd like to get your 23 comments on the draft EIS.
24 I note this will be the same slides as 25

3 If you provided comments previously, you're welcome 4
to give them again, but it is not necessary for 5
them to be considered since the first meeting was 6
transcribed.
7 So back to why we are here today.
8 Specifically the NRC issued for public comment a 9
draft Environmental Impact Statement, or DEIS, 10 published as NUREG-1437, Supplement 7(a), Second 11 Renewal of the Site-Specific Environmental Impact 12 Statement for License Renewal of Nuclear Plants 13 Regarding Subsequent License Renewal for North Anna 14 Power Station Units 1 and 2 Draft Report for 15 Comment.
16 The DEIS supersedes the draft 17 supplemental Environmental Impact Statement 18 published as NUREG-1437, Supplement 7,
Second 19 Renewal. And that was published for public comment 20 on August 25th of 2021 and includes the NRC staff's 21 site-specific evaluation of the environmental 22 impacts of the subsequent license renewal, SLR, for 23 North Anna for each of the environmental issues 24 that were previously dispositioned as Category 1 25

1 The DEIS considers information 2
contained in the Virginia electric and power 3
company, Dominion, also known as the Applicant, 4
September 28th, 2022 submittal which supplemented 5
its environmental report in the Dominion's 2020 SLR 6
application.
The DEIS also considers 7
whether there is significant new information that 8
would change the NRC staff's conclusions concerning 9
Category 2 issues specific to individual nuclear 10 power plants in the August 2021 DSEIS. The NRC 11 staff prepared the DEIS in accordance with the 12 Commission's direction from February 2022.
13 The meeting will have two parts.
14 First, we'll hear a presentation from the NRC staff 15 on the topics at hand. And then we will hear from 16 you on comments that you may have on the DEIS. And 17 that is the real reason why we're here today, to 18 listen to you.
19 The NRC categorizes this meeting as a 20 comment gathering meeting, so we will be actively 21 seeking your input after we complete our 22 presentation. We'll be going over the various ways 23 that you can provide your comments at this meeting 24 once we have finished the presentations.

16 He is the license renewal safety project manager.
17 And then Tam Tran. He is the environmental project 18 manager.
19 With that, I'll turn things over to 20 Andrew and Tam and I'll come back after the 21 presentation.

1 Next slide, please? This slide has an 2
overview of today's presentation. I'll take a 3
moment to talk about the NRC regulatory role and 4
its mission. Next I'll touch on the background for 5
the North Anna application and then I'll present 6
the overview of the North Anna license renewal 7
project milestones. And Tam Tran will present the 8
staff environmental review and results. Then we'll 9
continue to the collection of public comments.
10 The NRC is an independent agency that 11 regulates the domestic use of nuclear materials 12 including the use of nuclear materials for electric 13 power generation such as North Anna Power Station.
14 NRC authority and environmental obligation comes 15 from three main statutes: the Atomic Energy Act, 16 the Energy Reorganization Act, and the National 17 Environmental Policy Act.
18 The Atomic Energy Act authorizes the 19 NRC to grant 40-year licenses for nuclear power 20 plants and to grant renewed operating licenses.
21 The Energy Reorganization Act created the NRC from 22 the Atomic Energy Commission.
The National 23 Environmental Policy Act, or NEPA, requires federal 24 agencies to prepare Environmental Impact 25

actions prior to deciding on the proposal.
2 The EIS provides a systematic approach 3
in evaluating environmental impacts of the proposed 4
action and alternatives to the proposed action.
5 The proposed action for North Anna is the 6
renewal of the operating licenses. The NEPA also 7
encourages public participation, as Steve 8
mentioned, which is part of the reason why we're 9
here today.
10 In conducting any review, the NRC's 11 mission is threefold: to ensure adequate protection 12 of the public health and safety, to promote the 13 common defense and security, and to protect the 14 environment.
15 For the North Anna license renewal 16 review the NRC objectives are to determine whether 17 North Anna can continue to be operated safely for 18 an additional 20 years and to determine the 19 environmental impacts from such continued 20 operation.
21 This slide shows licensing history for 22 North Anna Power Station. North Anna received its 23 operating licenses for Unit 1 and Unit 2 on April 24 1st, 1978 and August 21st, 1980, for 1 and 2, 25

April 1st, 2038 and August 21st, 2040, if they are 2
not renewed. The license renewal for North Anna 3
would allow continued operation for these units for 4
an additional 20 years.
5 This slide lists the license renewal 6
application review milestones and status and is 7
available on the NRC public website. So if you 8
can't see it right now, you can blow it up from the 9
website.
As you can
- see, we received the 10 application in August of 2020 and accepted it in 11 October of 2020. We issued the draft Environmental 12 Impact Statement on December 28th, 2023 and the 13 draft EIS comment period will end on February 22nd, 14 2024.
15 Looking ahead, we plan to issue the 16 final EIS in July. Also in July the US EPA Federal 17 Register notice will be published for the 18 availability of the final EIS. We expect to have 19 the final decision on the issuance of the renewed 20 license in August of 2024.
21 And now I'll turn it over to Tam.
22 MR. TRAN: Thank you. My name is Tam 23 Tran. I'm an environmental project manager for the 24 North Anna Power Station subsequent license 25

review by staff.
2 The NRC staff documents its environment 3
review in an EIS which incorporate public comments, 4
and it is publicly available for inspections.
5 Some environmental impacts related to 6
license renewal are similar across multiple plants; 7
to improve efficiency the NRC use generic EIS to 8
address this impacts that are common to all nuclear 9
power plants, or for the distinct subsets of 10 plants. For example, plants that use cooling tower 11 or plants that use cooling pond are subsets of 12 plants in the generic EIS.
13 As part of the environmental review the 14 NRC staff examines the conclusions in the generic 15 EIS to determine if there is any new significant 16 information. In plain language in the supplemental 17 EIS the staff answers the question is there any new 18 significant information that would change the 19 conclusions in the generic EIS?
20 The staff also supplement the generic 21 EIS with a discussion of the environmental impacts 22 that are specific to North Anna Power Station 23 license renewal. For North Anna Power Station the 24 results are documented in a supplemental EIS and a 25

1 In 2021 staff issue a draft SEIS for 2
public comment. In 2023, consistent with the 3
Commission direction, staff issued a site-specific 4
draft EIS for public comment. The site-specific 5
draft EIS serves three purposes: (A) address all, 6
upon a site-specific basis, those issues that were 7
previously treated as generic issues in the 2021 8
draft EIS; (B) updates and revises the evaluation 9
of the site-specific issues in the 2021 draft SEIS; 10 and (C) addresses public comment received on the 11 2021 draft SEIS.
12 For environmental review the NRC looks 13 at a wide range of environmental resources and 14 evaluates the impact to these resource areas from 15 the continued operation of North Anna. This slide 16 illustrates the resources that the NRC reviews. As 17 is documented in the draft EIS, the staff looked at 18 socioeconomics, air quality, water quality, human 19 health, aquatic ecology, terrestrial ecology, et 20 cetera.
21 In performing the environmental review, 22 the staff is aided with information from: (A) the 23 license renewal application; (B) consultation with 24
- federal, state,
- Tribal, and local government 25

environmental review, which includes audit of the 2
North Anna Power Station; and (D) public comments 3
such as from today's meeting.
4 The NRC staff addresses its 5
environmental resource area by analyzing the 6
impacts that the operation of North Anna Power 7
Station may have on the resource area. The staff 8
then categorizes the impact level as
- small, 9
moderate, or large. These impact levels are 10 defined as: (A) the impacts are not detectable or 11 noticeable; (B) the impacts are detectable but does 12 not destabilize the resource area; or (C) the 13 impacts are sufficiently substantial which alter 14 and destabilize the resource area.
15 For some environmental resource areas, 16 the categorization of the impact is dictated by 17 statutes or executive orders and not by the NRC's 18 small, moderate, or large determinations. This 19 slide shows the definition of the impact for 20 threatened and endangered species and essential 21 fish habitats.
22 Under the Endangered Species Act there 23 are three levels of impact: (A) no effect; (B) may 24 affect is not likely to adversely affect or modify; 25

or modify.
2 Similarly, under the Magnuson-Stevens 3
Act there are three levels of impact: (A) no 4
adverse impact; (B) minimal adverse impact; and (C) 5 substantial adverse impact.
6 This slide shows the definition of 7
impacts for cultural and historic resources and 8
environmental justice. For environmental justice 9
the staff follows the Commission guidance in 10 looking at whether there is disproportionately high 11 adverse human health environmental effects on 12 minority and low-income populations.
13 For North Anna the preliminary results 14 show impacts for all of the resource areas listed 15 on this slide including land use, air quality, 16 surface water, groundwater, aquatic and terrestrial 17 resources, and socioeconomic, et cetera.
18 With respect to special species and 19 habitats, the continued operation of North Anna may 20 affect but it's not likely to adversely affect the 21 northern long-eared
- bat, tri-colored
- bat, and 22 monarch butterfly and has no adverse effects on 23 essential fish habitats. In evaluating the impacts 24 for special status species and habitats the staff 25

National Marine Fishery Service, as appropriate.
2 In looking at historic and cultural 3
resources the staff consulted with state historic 4
preservation officer and Tribal nations that have 5
historical ties with the North Anna Power Station 6
vicinity. The preliminary results indicate that 7
the proposed action, which is license renewal, will 8
not adversely affect historic properties. This is 9
based on: (A) any known location of historic 10 properties within and hear the area of potential 11 effect; (B) Tribal input; (C) the applicant's 12 administrative procedure; (D) state historic 13 preservation officer input; and (E) no planned 14 physical changes or ground-disturbing activities.
15 For environmental justice the 16 preliminary results show no disproportionately high 17 adverse human health and environmental effects on 18 minority and low-income populations.
19 For cumulative impacts the National 20 Environmental Policy Act requires the staff to take 21 a hard look at the impacts of continued operation 22 of North Anna Power Station in combination with 23 other past, present, and reasonably foreseeable 24 future action in the area. The results are 25

further discussed on the next slide.
2 For postulated accident at North Anna 3
Power Station the results are discussed in the 4
draft EIS Section 3.11.6.9, specifically the 5
results of the severe accident mitigation 6
alternative review listed in Appendix F of the 7
draft EIS.
8 This slide shows all the actions nearby 9
North Anna which were considered by the NRC staff 10 for cumulative impacts to the environment. This 11 includes on-site
- projects, fossil fuel and 12 renewable energy facilities in the vicinity, nearby 13 military facilities, et cetera, as listed on this 14 slide and in the Appendix E of the EIS.
15 For alternatives to North Anna license 16 renewal the staff initially considered 16 17 alternatives.
For reasons of technical 18 consideration, resource availability limitations, 19 commercial limitations, or regulatory limitations 20 the staff eliminated 13 alternatives from in-depth 21 evaluations.
The staff evaluated two 22 power replacement alternatives in depth in the 23 draft EIS.
These are:
(A) new nuclear 24 alternatives; (B) a combination alternative 25

reactor, and demand side management. The staff 2
also evaluate the no-action alternative for which 3
North Anna licenses are not renewed.
4 Table 2-2 in the draft EIS shows impact 5
comparison of North Anna license renewal with 6
alternatives to license renewal. Each of the two 7
reasonable replacement power alternatives has 8
environmental impacts in at least four resource 9
areas that are greater than impacts of license 10 renewal for North Anna.
11 In considering reasonable replacement 12 power alternatives the staff consulted with 13 information from various sources including: (A) the 14 applicant's environmental report; (B)
U.S.
15 Department of Energy and U.S.
Environmental 16 Protection Agency reports; and (C) power industry 17 sources and publications.
18 As discussed in the draft EIS, the 19 staff conclusions show the adverse environmental 20 impacts of North Anna Power Station license renewal 21 are not so great that preserving the option of 22 license renewal for energy planning decision maker 23 would be unreasonable. In plain language the 24 environmental impacts of continued operation of 25

would warrant the denying of the renewed licenses.

20 This slide show how you can submit 21 comments on the draft EIS. The NRC will accept 22 comments through February 22nd, 2024. You can 23 submit comments by mail or through the 24 regulations.gov website. You can download this 25

KOENICK: Seeing that there are no 12 questions or comments on the presentation, the next 13 step would be to open up the floor to members of 14 the public who wish to provide any comments on the 15 draft Environmental Impact Statement. Do we have 16 anybody who wants to make a comment on the draft 17 Environmental Impact Statement?

19 MR. KOENICK: Okay. What I will do is 20 I will provide a brief understanding of the next 21 steps and then I would offer that we'll probably 22 hang out for -- until about quarter of 8:00 and 23 then probably conclude the meeting.
24 So, a brief understanding of the next 25

consider all comments received on the DSEIS, or the 2
DEIS. That is from the transcription of the 3
webinar held last week, as well as any comments 4
submitted by the methods that Tam offered. And 5
they will be documented in Appendix A of the final 6
Environmental Impact Statement.
7 And the next steps for the staff will 8
be to collate all the comments received during the 9
comment period and provide responses to those 10 comments. Some of the comments will be actually 11 incorporated into the EIS itself while others will 12 just be dispositioned within Appendix A.
13 The North Anna final EIS is scheduled 14 to be published in July of 2024.
15 And for today's meeting a
meeting 16 summary will be issued and will be posted on the 17 North Anna Project website.
