VERMONT YANKEE NUCLEAR POWER STATION - RESPONSE TO WITHDRAWAL OF REQUESTED LICENSING ACTION REGARDING A LICENSE AMENDMENT SUBMITTED FOR APPROVAL OF THE LICENSE TERMINATION PLAN (EPID L-2023-LLA-0166)

By letter dated October 10, 2023 (Agencywide Documents Access and Management System (ADAMS) Accession No ML23285A131), NorthStar Nuclear Decommissioning Co., LLC (NNDC) (the licensee) requested U.S. Nuclear Regulatory Commission (NRC) approval to add a condition to include License Termination Plan (LTP) requirements to Facility Operating License No. DPR-28 for Vermont Yankee Nuclear Power Station (VY). By letter dated February 27, 2024 (ML24058A439), you requested to withdraw the application from NRC review. The NRC acknowledges your request to withdraw the application. NRC staff activities on the review have ceased and the associated Cost Activity Code number has been closed.
Prior to your request to withdraw, the NRC was performing an acceptance review on your application. The purpose of an acceptance review is to determine if there is sufficient technical information in scope and depth to allow the NRC staff to complete its detailed technical review. The acceptance review is also intended to identify whether the application has any readily apparent information insufficiencies in its characterization of the regulatory requirements or the licensing basis of the plant.
Consistent with Section 50.90 of Title 10 of the Code of Federal Regulations (10 CFR), an application for an amendment to a license must fully describe the changes requested, and following as far as applicable, the form prescribed for original applications. NUREG-1700, Rev.
2, and/or the applicable sections or appendices in NUREG-1757, Vol. 2, Rev. 2 provide guidance for meeting the regulatory requirements for license termination plans. The NRC staff notes that its review of the application prior to the withdrawal request identified that your application did not provide adequate technical information in sufficient detail to enable the staff to complete its detailed review. Therefore, should you decide to re-submit the request, please review the statements provided in Enclosures 1 and 2 to this letter. The content of the enclosures are based on review of the LTP against the guidance for acceptance and safety reviews of LTPs in NUREG-1700, Rev. 2, and/or the applicable sections or appendices in NUREG-1757, Vol. 2, Rev. 2. Enclosure 1 contains items the staff would expect to see included in a future application, and Enclosure 2 contains items that the staff may request upon further March 1, 2024

The staff is also including observations on information that NRC staff could potentially request later in Enclosure 2. The observations are not the result of a detailed technical review and responses are not currently required for the NRC staff to begin its detailed technical review of the application. However, the NRC staff is providing these observations to allow you to address items which that may potentially become a request for additional information if you decide to re-submit this request.
In accordance with 10 CFR 2.390 of the NRCs Agency Rules of Practice and Procedure, a copy of this letter will be available electronically for public inspection in the NRC Public Document Room or from the Publicly Available Records component of NRCs ADAMS.
