STP 73.5 Exemption Request RAI Issued 2024-02-20.pdf
Dear Ms. Brost,
By letter dated November 16, 2023 (ML23324A010), STP Nuclear Operating Company (STPNOC) requested an exemption for South Texas Project, Units 1 and 2 and the independent spent fuel storage installation (STP). In particular, STPNOC requested an exemption from the specific requirements in 10 CFR Part 73, Subpart T, and for the definitions for the terms "Contraband," and "Time of Discovery" in 10 CFR 73.2 until the later of March 31, 2025, or 180 days after publication of the final Regulatory Guides.
The NRC staff has determined that additional information is needed to complete its review. The requests for additional information (RAIs) were transmitted to the licensee in draft form on February 16, 2024. On February 20 you indicated that a clarification call was not needed and that the licensee agreed to provide responses to the RAls by March 21, 2024. The NRC staff agrees with this date.
Respectfully, Dennis Galvin Project Manager U.S Nuclear Regulatory Commission Office of Nuclear Reactor Regulation Division of Operating Reactor Licensing Licensing Project Branch 4 301-415-6256 Docket Nos. 50-498, 50-499, and 72-1041

REQUEST FOR ADDITIONAL INFORMATION REQUEST FOR EXEMPTION FROM ENHANCED WEAPONS, FIREARMS BACKGROUND CHECKS, AND SECURITY EVENT NOTIFICATIONS STP NUCLEAR OPERATING COMPANY SOUTH TEXAS PROJECT, UNITS 1 AND 2 DOCKET NOS. 50-498, 50-499, AND 72-1041 EPID NO. L-2023-LLE-0046
Background:
By letter dated November 16, 2023 (ML23324A010), STP Nuclear Operating Company (STPNOC) requested an exemption for South Texas Project, Units 1 and 2 and the independent spent fuel storage installation (STP). In particular, STPNOC requested an exemption from the specific requirements in 10 CFR Part 73, Subpart T, and for the definitions for the terms "Contraband," and "Time of Discovery" in 10 CFR 73.2 until the later of March 31, 2025, or 180 days after publication of the final Regulatory Guides.
Technical Basis for Request: The licensee justification for the duration of the exemption is based on the completion of the regulatory guidance and the time necessary for STPNOC to go through the change management processes adequately to include the number of training weeks that will be required. However, the impacts identified by the licensee to the change management processes and training schedules appear to be generic to the nuclear industry and do not provide site-specific impacts and timelines to support the March 31, 2025, exemption duration date.
Request: Provide additional justification for delaying implementation of 10 CFR Part 73, Subpart T, requirements and for the terms Contraband and Time of Discovery to the March 31, 2025, exemption duration date. Include information regarding the site-specific impacts and the expected timeline needed to revise the security programs, procedures, and training for personnel in order to support STPNOCs requested duration for the exemption. Alternatively, revise the exemption request for the requested calendar date for implementation of Subpart T and the definitions of Time of Discovery and Contraband.
