SUMMARY

OF THE JANUARY 26, 2024, OBSERVATION PREAPPLICATION PUBLIC MEETING WITH SMR, LLC (A HOLTEC INTERNATIONAL COMPANY)

TO DISCUSS THE STAFF INFORMATION NEEDS FOR THE TOPICAL REPORT ON THE QUALITY ASSURANCE PROGRAM FOR HOLTEC INTERNATIONALS SMALL MODULAR REACTOR DESIGN AND CONSTRUCTION Meeting Summary The U.S. Nuclear Regulatory Commission (NRC) held an observation public meeting on January 26, 2024, with SMR, LLC (SMR), a Holtec International Company (Holtec), to discuss the SMR (Holtec) proposed resolutions to the information needs provided by the NRC staff related to the Topical Report On the Quality Assurance Program for Holtec Internationals Small Modular Reactor (SMR) Design and Construction. 1,2 The NRC staff provided a numbered list of information needs to SMR (Holtec) on January 19, 2024.3 This virtual observation preapplication meeting had attendees from SMR, (Holtec) and the NRC staff. There were no members of the public who attended the meeting.

No decisions or commitments were made during this meeting.

The following summarizes the discussion during the meeting:

Following the introductions of both the NRC staff and SMR (Holtec) staff, SMR (Holtec) presented its proposed solution to each of the NRC staff provided information needs.

SMR (Holtec) specified that it only intends to use the topical report for a construction permit application under 10 CFR Part 50.

For Item #4, the NRC staff asked if SMR (Holtec) plans to conform to the Regulatory Guide (RG) 1.28 as it relates to the qualification of Quality Assurance auditors. SMR (Holtec) stated that it intends to follow RG 1.28 without exception.

For Item #11, the NRC staff clarified the need to address out of calibration measuring and test equipment (M&TE) and the extent of condition needed to address previous inspection and test results when an M&TE is found to be out of calibration.

2 Regarding Item #17 (b), the NRC staff discussed SMR (Holtec)s resolution. SMR (Holtec) proposed to delete the entire paragraph in question but will also add additional context for how it plans to audit activities that last less than one year.

In Item #20 (a), SMR (Holtec) clarified that it planned to commit to RGs 1.26, 1.28 and 1.29, without exception.

In Item #20 (b), SMR (Holtec) plans to commit to RG 1.164, RG 1.231 and RG 1.234 with exceptions. SMR (Holtec) plans to list these exceptions explicitly in the subsequent application. The NRC staff stated that if SMR (Holtec) plans to commit to certain RGs with exceptions, the NRC staff will include plant specific conformance requests within the Safety Evaluation.

At the end of the meeting, SMR (Holtec) stated that it intends to submit a revised topical report to address the information needs that the NRC staff provided.

The meeting was adjourned at 2:53 PM.
