Administrative Issues Proposed Scope of Work and Budget for 2024 EPM submitted a proposed scope of work and budget for 2024 on December 27, 2024. The DEQ sent EPM an email outlining their understanding of the design and bidding process, asking for clarification if that was not accurate.
EPM will respond to the DEQs email clarifying the advancement of the design and the solicitation of bids. The NRC and the DEQ will review the proposed scope of work and budget and respond to the request as soon as practical.
Request to Reallocate Funding EPM facilitated two presentations on the decommissioning plan in June. While discussing the creation of reducing conditions during the 2017 Pilot Test Trench activity in BA1, EPM committed to provide a report on the BA1 Redox Evaluation by the end of the year. The scope of work for this activity only provided for two sampling events, not the compilation of all redox data and preparation of the report.
The scope of work for site maintenance assumed th at EPM would be able to contract with a third party to mow and harvest grass from approximately 200 acres of the site, including the floodplain in the Western Alluvial Area and portions of BA1. Although EPM met with several people, none were willing to execute a contract, due to restrictions on their access to the site.
Consequently, Mills Construction (the company that maintains access to monitor wells) had to mow a portion of those areas that had been slated for harvesting.
Finally, during the development of responses to NRCs requests for information (RAIs) related to the environmental assessment, it became apparent that the Basis of Design for the groundwater extraction and injection systems needed to be updated.
There is sufficient funding in the budget for Burns & McDonnell in budget Task 4 - Site Decommissioning, but the budget presented the allocation of funds between several of Burns &
McDonnells Task 4 work, and funds from one of Burns & McDonnells tasks needs to be transferred to the tasks listed above.
EPM submitted a request to reallocate funds between Burns & McDonnells tasks on November 15, 2023. The DEQ approved this reallocation in a letter dated November 27, 2023.

The NRC will review the request to reallocate funds and respond to the request as soon as practical.
Decommissioning Issues NRC Review of the Environmental Assessment A November 3, 2023, letter from the Oklahoma Archeological Survey stated that they concur with the NRCs findings and recommendations related to historic resources, and that the NRC must also receive a letter from the State Historic Preservation Office (SHPO) to document the NRCs consultation.
A November 6, 2023, letter from the SHPO stated that the SHPO concurs with the NRC that the Emergency Response Building, the MOFF Building, Warehouse #4, and the three diesel pumps are eligible for listing in the National Register of Hi storic Places. The letter stated that the project (site decommissioning) will have no adverse ef fect on the historic property, provided the following condition is met: all trenching and ground cover site work associated with the project is to be returned to pre-construction condition at the projects completion.
The NRC requested a call to discuss this condition on November 30, and provided copies of these letters to EPM on December 4, 2023. This initiat ed a series of emails related to a proposed revision of the SHPOs condition to clarify that the Western Area Treatment Facility, pavement, fencing, and site roads will remain in place. On January 5, 2024, the NRC finalized the proposed revision of the SHPOs condition, and notified EPM that they will respond accordingly.
The NRC will respond to the SHPO. Copies of the Environmental Assessment will be send to the DEQ, the SHPO, and the Oklahoma Archeological Society for review.
Responses to RAIs for the Safety Evaluation Report The NRC issued requests for information (RAIs) related to the safety evaluation report in a letter dated October 2, 2023. RAIs were assigned to one of two categories: groundwater remediation (GWRM) and health physics (HP). Responses to the RAIs were submitted to the NRC on December 12, 2023.
The NRC will review the responses and notify EPM if the responses are acceptable, or if additional information is needed.
Response to the RAI Related to Nuclear Criticality Safety The NRC issued one RAI related to its nuclear criticality safety evaluation in a letter dated November 1, 2023. EPM submitted a response to the RAIs on November 15, 2023.
The NRC will review the responses and notify EPM if the response is acceptable, or if additional information is needed.
Burial Area #1 Redox Evaluation Report EPM submitted Burial Area #1 Redox Evaluation Report on January 17, 2024. This report presented data for groundwater in and around Groundwater Extraction Trench GETR-BA1-01,

with an evaluation of the impact of dissolved organics on the redox conditions in the water-bearing zones. The primary conclusions are:
- 1. Generally, redox conditions have rebounded or appear to be rebounding to near background conditions.
- 2. The creation of aquifer reducing conditions is not anticipated to significantly impact the duration of groundwater remediation in BA1.
- 3. Additional redox sampling events are not recommended.
The NRC and the DEQ will review the report and provide comments, if any, to EPM.
