PENNSYLVANIA STATE UNIVERSITY ANNUAL SELF-GUARANTEE FOR SPECIAL NUCLEAR MATERIALS LICENSE-95 (ENTERPRISE PROJECT IDENTIFICATION CODE: L-2024-NFO-0000)

Dear Virginia Teachy:

By letter dated December 28, 2023 (Agencywide Documents Access and Management System

[ADAMS] Accession No. ML23362A021), you submitted to the U.S. Nuclear Regulatory Commission (NRC) a document with a certified amount of financial assurance and associated annual self-guarantee (SG) test for Special Nuclear Materials License (SNM)-95 for the Pennsylvania State University (PSU). The NRC staff conducted a technical review of the adequacy of the submittal for SNM-95.

An evaluation of the analysis for the materials license is enclosed. The NRC staff concludes that the PSU SG agreement meets the financial test criteria for a nonprofit college that issues bonds.

The PSU conforms to the guidance in NUREG-1757, volume 3, revision 1 Consolidated NMSS Decommissioning GuidanceFinancial Assurance, Recordkeeping, and Timeliness, and meets the applicable requirements of Title 10 of the Code of Federal Regulations (10 CFR) Part 30 and 10 CFR Section 70.25. Enclosed is a summary of the NRC staffs review of PSUs submittal.

As a reminder for the 2023 submittal, the SG must be submitted within 90 days of the close of the fiscal year. The requirements are established by the Final Decommissioning Planning Rule and the guidance provided in NUREG-1757, volume 3, revision 1.

The Enclosure transmitted herewith contains proprietary non-public information.
