LETTER OF INTENT TO SUBMIT A LICENSE APPLICATION FOR THE THORIUM RECOVERY CIRCUIT AT THE PEA RIDGE MINE, SULLIVAN, MISSOURI
Dear Mr. Kennedy:
I am writing to acknowledge receipt of your letter of intent, dated November 28, 2023, to apply for a license for a thorium recovery circuit located at the Pea Ridge Mine in Sullivan, Missouri (Agencywide Documents Access and Management System (ADAMS) Accession No. ML23342A194).1 The U.S. Nuclear Regulatory Commission (NRC) staff understands that you are seeking a license under Title 10 of the Code of Federal Regulations (10 CFR), Part 40, Domestic Licensing of Source Material, which applies when thorium concentrations exceed 0.05-percent by weight threshold identified in 10 CFR Part 40.13(a).
The NRC staff cannot make any regulatory determinations prior to receipt and review of an application, and recommends additional interactions through pre-submission meetings to further discuss the project. Pre-submission meetings would allow the NRC staff to better understand the proposed processes that would be used to recover thorium from the iron mine tailings and your plans to recover thorium from other sources as well. With a better understanding of your proposed activities, the NRC staff can provide better perspective on the applicable guidance, environmental review, and regulatory requirements.
The NRC staff also notes that because review of your potential application has not been considered in development of its budget, the NRC staff will need to evaluate its workload to determine available resources with respect to the timing of the review.
1 The NRC staff also received a letter of intent for an apparently associated proposal for a Thorium Storage/Manufacturing Facility from the Thorium Energy Alliance (ADAMS Accession No. ML23305A131).
