Dear Brian Goretzki:

We have reviewed the final revisions to the Arizona radiation regulations Title 9, Chapter 7, received by our office on November 2, 2023. These regulations were reviewed by comparison to the equivalent U.S. Nuclear Regulatory Commission (NRC) rules and the requirements of Regulation Amendment Tracking System Identification Numbers (RATS ID) 2018-1, 2018-2, 2018-3, 2019-1, 2019-2, 2020-1, 2020-2, 2020-3, 2021-1 and 2021-2 as identified in the enclosed State Regulation Status (SRS) Data Sheet. We discussed our review of the regulations with you on January 24, 2024.

As a result of our review, we have four comments that has been identified in Enclosure 1.

Please note that we have limited our review to regulations required for compatibility and/or health and safety. We have determined that if these regulations are revised, incorporating our comments and without other significant change, they would meet the compatibility and health and safety categories established in the Office of Nuclear Material Safety and Safeguards (NMSS) Procedure SA-200, Compatibility Categories and Health and Safety Identification for NRC Regulations and Other Program Elements.

We request that when you revise your regulations to address our comments, a copy of the as published regulations be provided to us for review. As requested in NMSS Procedure SA-201, Review of State Regulatory Requirements, please highlight the location of any changes made and provide a copy to Division of Materials Safety, Security, State, and Tribal Programs, NMSS.

The SRS Data Sheet in Enclosure 2 summarizes our knowledge of the status of other Arizona regulations, as indicated. Please let us know if you note any inaccuracies or have any comments on the information contained in the SRS Data Sheet. General security program requirements Arizona omitted the sentence "the list of individuals that have been approved for unescorted access" in R9-7-1943(d)(2) and (3) and (5)-(8) that was supposed to be added. The result would be less restrictive (which goes beyond Category C) instead of more restrictive.

Arizona needs to add the sentence to meet the Category C designation assigned to 10 CFR 37.43(d)(2),

The entire section of Arizonas regulation R9-7-711 is different from 10 CFR 35.57 including the title of the section.

Arizona needs to amend and revise the entire section of R9-7-711 and mirror the language as written in § 35.57 to ensure it is essentially identical to 10 CFR 35.57 to meet the Compatibility B designation.
