SUMMARY

OF THE REACTOR OVERSIGHT PROCESS BIMONTHLY PUBLIC MEETING HELD ON NOVEMBER 16, 2023 On November 16, 2023, the U.S. Nuclear Regulatory Commission (NRC) staff hosted a public meeting with the Nuclear Energy Institutes (NEIs) Reactor Oversight Process (ROP) Task Force executives, other senior industry executives, and various external stakeholders to discuss the staffs progress on initiatives related to the ROP. The topics discussed during this hybrid meeting are described below.

Public Workshop to Discuss Corporate Inspections The NRC staff discussed planning for a public workshop in December to explore developing corporate level inspections.

Presentation - December Public Workshop to Discuss Corporate Inspections - ML23305A166 Draft FAQ for Turkey Point Unplanned Scrams Performance Indicator NextEra staff introduced a draft FAQ related to a site-specific exemption for IE01, Unplanned Scrams per 7000 hours0.081 days <br />1.944 hours <br />0.0116 weeks <br />0.00266 months <br />. Turkey Point Unit 3 experienced a scram on September 22, 2023 caused by a lightning strike and grid disturbance. The NRC staff accepted this as FAQ 23-03 for review.

P. Finney Discussion of AP1000 White Paper A short discussion was held regarding the original, proposed modifications to the Main Feedwater section that will be removed.

ROP Whitepaper Modification of the Description of Unplanned Scrams with Complications Performance Indicator to Reflect AP1000 Design - ML23136A607 Update on NRC Review of Draft NEI 99-02 Revision 8 NRC staff are reviewing a draft revision 8 to NEI 99-02. The NRC staff asked several questions regarding proposed examples of unplanned scrams that would not count as unplanned scrams, MSPI revisions, and the absence of citied FAQ examples. The NRC will continue to review NEI 99-02 Rev. 8 and will provide comments at future meetings.

Enhancing Oversight of Probabilistic Risk Assessment Configuration Control The NRC staff presented a status update on the Probabilistic Risk Assessment (PRA)

Configuration Control (PCC) effort. This presentation provided additional details on a draft Operating Experience Smart Sample (OpESS) and provided additional details on the NRCs proposal for the PCC Significance Determination Process (SDP).

Industry provided several comments related to the proposal, specifically that the NRCs intent in the OpESS was consistent with evaluating configuration control programs, versus inspection of the PRA itself. Industry stated that several aspects of the OpESS language could benefit from enhanced clarity and offered to provide suggestions. Industry also suggested an NRC workshop to explore approaches to conducting associated inspections and mock SDP evaluations.

Presentation - Enhancing Oversight of PRA Configuration Control - ML23315A000 Draft Operating Experience Smart Sample - ML23312A335 Inspection Procedure (IP) 71152, Problem Identification and Resolution (PI&R) Revision The NRC staff issued a revision to IP 71152 with an effective date of January 1, 2024 (ML23214A284). At the meeting, NRC staff provided an overview of the changes to the IP resulting from Commission direction in SRM-SECY-22-0087 and the approved recommendations associated with the PI&R comprehensive review (ML20247J590).

Specifically, the staff discussed the addition of qualitative criteria that provide assessment guidance for the performance and documentation of biennial team inspections. In addition, the staff discussed the addition of an inspection requirement and guidance for confirming that a licensees PI&R program complies with NRC regulations.

Presentation - Problem Identification and Resolution - ML23313A148 P. Finney Compliance with Price-Anderson Act Provisions (10 CFR Part 140)

NRC staff presented two final rules recently published that amended 10 CFR 140.11 to comply with the Price-Anderson Act. In response to questions, the staff briefly explained how the revisions were non-discretionary adjustments required by statute and how the direct final rule (DFR) process differed from that used to revise 10 CFR 140.

Presentation - Compliance with Price-Anderson Act Provisions - ML23319A341 Revision to Inspection Manual Chapter (IMC) 0309, Reactive Inspection Decision Basis for Reactors NRC staff provided an update on IMC 0309 revisions in progress in response to an Office of the Inspector General (OIG) reactive inspection audit in May 2023. The following is a link to the OIG audit: https://www.oversight.gov/sites/default/files/oig-reports/NRC/ROAOIG-23-06FinalMay 2023HVSSC.pdf Other Items Discussed NRC staff provided an update on 10 CFR 50.72(b) non-emergency reporting requirements rulemaking efforts. The staff expect to issue draft rule language and guidance in May 2024 that will be available for a 75-day public comment period. The NRC staff also expects to issue a draft supplement to the non-emergency reporting requirements guidance specifically to clarify the degraded and unanalyzed condition criteria [10 CFR 50.72(b)(3)(ii) and 10 CFR 50.73(a)(2)(ii)]

in January 2024 for public comment.

NRC staff also provided information on a pending Information Notice concerning the discontinuation of legacy, copper-based technology, and the potential impact to emergency communications. Following issuance, the NRC intends to contact affected licensees to provide options to ensure instantaneous and uninterrupted communications between licensees and the NRC for emergencies. This Information Notice will not require actions by licensees.

The Next ROP Meeting The next ROP bimonthly public meeting is tentatively scheduled for January 17, 2024.

Communicating with the NRC Staff At the start of all ROP public meetings, the project manager provides contact information for the public to use to provide their name and affiliation as a participant in the meeting. This contact information is also provided for submitting questions and comments to the NRC technical staff.

Conclusion At the end of the meeting, NRC and industry management gave closing remarks. The industry representatives expressed appreciation for the open dialogue and willingness of NRC staff to hear industry views. The NRC management stressed the importance of the NRC being focused P. Finney on providing reasonable assurance of public health and safety when considering changes to the ROP.
