Environmental Impact Statement final rule: Cumulative 5

Effects of Regulation virtual public meeting. The 6

purpose of this meeting is to discuss the effective 7

and compliance dates of the draft final rule and 8

obtain public feedback as it pertains to cumulative 9

effects of regulation.

afternoon and welcome to the NRC's Cumulative Effects 4

of Regulation Public Meeting for the LR GEIS 5

rulemaking, Generic Environmental Impact Statement.

6 As Lynn already said, I'm Trish Holahan.

7 I'm the Director of Subsequent License Environmental 8

Directorate, commonly known inside the agency as SLED, 9

in the Office of Nuclear Materials Safety and 10 Safeguards at the NRC.

Thank you all for 11 participating in this meeting.

12 With me today is my new Deputy Director, 13 Ilka Berrios, along with our rulemaking PM, Yanely 14 Malave-Velez, and our Environmental Project Managers, 15 Jennifer Davis, Kevin Folk, and Bob Hoffman, and our 16 Safety PM Bill Rogers.

17 This has been a challenging project and we 18 appreciate the public interest demonstrated by the 19 comments submitted on the proposed rule, LR GEIS, and 20 associated guidance.

21 Today, we will be discussing the effective 22 and compliance dates that are being considered for 23 draft final rule and its impact on the cumulative 24 effect of regulations. Thank you for participating 25

have to turn it over to Yanely.

2 MS. MALAVE: Well, good afternoon, 3

everybody, and welcome. As mentioned before, my name 4

is Yanely Malave-Velez. I'm the rulemaking project 5

manager for this project. And in terms of agenda, 6

we'll discuss first the purpose of the meeting and 7

then what it means, cumulative effect of regulation.

8 Then I will provide a brief summary of the proposed 9

rule amendments, a brief summary of the changes that 10 we did in the draft final rule based on public comment 11 that we received. Then we're going to have a brief 12 discussion on the effective and compliance dates that 13 we're going to be proposing to the Commission, and 14 then you will have the opportunity to provide your 15 feedback and questions.

16 Next slide, please. So, a brief reminder 17 to everybody. We issued the proposed rule on March 18 3rd of this year for a 60-day public comment [period].

19 After that, public comment [period] ended on May 2nd, 20 and now the expectation that we are working towards is 21 to submit a draft final rule package to the Commission 22 in March of 2024.

23 Next slide. What does it mean, cumulative 24 effects of regulation? CER, as is commonly known, is 25

licensees and other entities face while implementing 2

multiple regulatory actions within a

limited 3

implementation period and within limited available 4

resources. This CER public meeting is intended to 5

obtain feedback during the draft final rule 6

development, which is the stage that we are currently 7

at, to inform the implementation schedule.

8 Next slide, please. What do we consider 9

for CER? We consider the changes from the proposed to 10 draft final rule and also the expectations that we as 11 the NRC have for the effective and compliance dates.

12 And also your feedback in this meeting.

13 Next slide, please. A summary of the 14 amendments that we did on the proposed rule to revise 15 the existing requirements for environmental reviews of 16 applications for a license renewal of operating 17 nuclear power plants. The amendments will codify the 18 updated generic conclusions of the revised license 19 renewal GEIS for those issues for which a generic 20 conclusion regarding the potential environmental 21 impact of issuing an initial or subsequent renewal 22 license for a nuclear power plant can be reached.

23 These conclusions have been updated to 24 specifically account for subsequent license renewal as 25

information since the 2013 license renewal guidance 2

update. These issues are identified as Category 1 3

issues in the revised license renewal GEIS. The 4

Category 1 issues identified and described in the 5

license renewal GEIS may be applied to any initial 6

license renewal or first subsequent license renewal 7

application for an operating nuclear power plant and 8

have been determined to have a small impact for all 9

plants or a subset of plants.

10 Table B-1 in Appendix B to Subpart A of 10 11 CFR Part 51 summarizes and codifies the Commission's 12 findings for all Category 1 issues.

13 The revision to Table B-1 accounts for 14 subsequent license renewal, reflects lessons learned, 15 knowledge gained, and experience from license renewal 16 environmental reviews performed since the development 17 of the 2013 license renewal GEIS. It also considers 18 changes to applicable laws and regulations and factors 19 in new scientific data and methodology with respect to 20 the assessment of potential environmental impacts of 21 nuclear power plant license renewal. In addition, we 22 make conforming changes to the provision of 10 CFR 23 51.53(c)(3) and 50.95(c).

24 Next slide. So, based on the public 25

rule text and one edit to Table B-1. One of the 2

comments was related to human health, which stated 3

that the proposed additions to Section 3.9.2.2 of the 4

license renewal GEIS regarding discharges to waters of 5

the United States infers reference to the Clean Water 6

Act, which had potential to expand the scope of this 7

issue if changes to the definition of the waters of 8

the United States ever occur in the future. In 9

addition, the comment recommends limiting the scope to 10 waters receiving discharges that are accessible to the 11 public for recreational use.

12 The NRC agrees with the comment to the 13 extent that the reference to the Clean Water Act shall 14 be removed. Members of the public shall be protected 15 from microbiological hazards resulting from plant 16 discharges into water bodies and not just to plant 17 discharges into waters of the United States. However, 18 the NRC does not agree that the scope of the Category 19 2 issue, microbiological hazards to the public, should 20 be limited to waters receiving discharges that are 21 accessible to the public for recreational use.

22 Therefore, we modify 10 CFR 23 51.53(c)(3)(ii)(G), the license renewal GEIS and the 24 guidance to reflect that members of the public could 25

(202) 234-4433 WASHINGTON, D.C. 20005-3701 (202) 234-4433 be exposed to microbiological organisms in thermal 1

effluents at nuclear plants that use cooling ponds, 2

lakes, canals, or that discharge to publicly 3

accessible surface waters.

4 The second comment that triggered changes 5

was one related to greenhouse gas emissions and 6

climate change. They stated that under the current 10 7

CFR Part 51 regulations, the NRC already has a 8

framework of considering additive climate change 9

impacts on environmental resources that may be 10 affected by license renewal on a site-specific basis.

11 Therefore, there is no need for the proposed new 12 Category 2 issue or Section 50.53(c)(3)(ii)(Q) to 13 consider the additive or incremental effects of 14 climate change or mitigation measures for purposes of 15 the NRC's license renewal NEPA evaluation.

16 The NRC agrees with the comments that the 17 NRC's regulations in 10 CFR 51.53(c)(3)(iii) already 18 require that environmental reports submitted by 19 license renewal applicants contain a consideration of 20 alternatives for reducing adverse impacts, as required 21 by 51.45(c), for all Category 2 license renewal issues 22 in Appendix B to Subpart A of Part 51.

23 Therefore, the NRC has revised the draft 24 final rule to eliminate this duplicative requirement 25

(202) 234-4433 WASHINGTON, D.C. 20005-3701 (202) 234-4433 specific to mitigation measures for climate change 1

impacts.

2 Next slide. In the proposed rule we had a 3

question to members of the public whether we can 4

extend the applicability of the license renewal GEIS 5

beyond two license renewal terms. After analyzing the 6

comments received from industry, some of them 7

supported the expansion citing an efficient use of 8

resources while a few members of the public opposed it 9

due to insufficient information on aging management.

10 Therefore, based on the public comments 11 received and the fact that the Agency has no knowledge 12 of utilities that are actively contemplating a third 13 renewal term; the staff found no reason to deviate 14 from the Commissions direction and the draft final 15 rule and license renewal GEIS will remain applicable 16 to one term of license renewal and one term of 17 subsequent license renewal.

18 Next slide, please. For the effective and 19 compliance dates, we are proposing an effective date 20 of 30 days after publication and then the compliance 21 date will be up to one year after the publication of 22 the rule.

23 Next slide. At this point we would like 24 to hear your feedback, comments, or concerns on the 25

1 MR. LIGHTY: Hi. Good afternoon. This is 2

Ryan Lighty. I was just wondering if you could expand 3

upon what is meant by effective date and compliance 4

date and distinguish the two.

5 MS. MALAVE: Effective date is when we 6

publish the rule and it starts being effective for 7

everybody that applies for a renewal. So that will be 8

30 days after the publication of the rule.

9 Compliance date means that any applicant 10 that is thought to [be] coming in or has submitted an 11 application will have up to a year after publication 12 to comply with the new rule.

13 MS. RONEWICZ: Okay, does that answer your 14 question?

15 MR. LIGHTY: It does in part and perhaps 16 just one clarification. So for the one year 17 compliance date, and environmental reports keyed to 18 the current GEIS, will the staff review it against the 19 current GEIS? Is that included in the compliance 20 window?

21 MS. MALAVE: Yes.

22 MR. FOLK: I'm sorry, Lynn, Kevin Folk 23 with the NRC staff. With regard to the effective date 24 of the rule, the staff will have to comply with the 25

1 MS. RONEWICZ: Okay, and then the next 2

person, Rachel Turney, you may go ahead, please.

3 MS. TURNEY: Thank you. This is Rachel 4

Turney-Work with Enercon.

5 Could you provide just a little bit more 6

and perhaps expand a little bit more on the change 7

that you discussed about the climate change issue? I 8

just wasn't sure if you were indicating that it was 9

being -- is it still being considered a Category 2 10 issue or are we continuing to consider it as part of 11 the cumulative impacts?

12 MR. FOLK: Yes, Rachel. Thanks for that 13 question. Kevin Folk for the NRC staff. The staff 14 thoughtfully considered all comments received on all 15 Category 1 and Category 2 issues and at present the 16 draft final rule is pre-decisional, but other than the 17 two changes that Yanely outlined, we did not make any 18

-- we have not proposed any substantive changes to the 19 rule. And that would include the list of issues in 20 Table B-1 of the rule.

21 MS. TURNEY: Thank you, Kevin. So the 22 change that was described, as it relates to climate 23 change, was specific to just the duplicative nature of 24 the two instances.

1 MS. RONEWICZ: Okay, and if there were no 2

other items on that, we will move on to Sherwin Turk, 3

you may go ahead, please.

4 MR. TURK: Hi. Thanks very much for taking 5

my question. This is Sherwin Turk. I work in the 6

Office of General Counsel.

7 Mr. Lighty had asked the question, but I 8

think the answer was a little bit confused. He was 9

asking about when a licensee or an applicant would 10 have to comply with the new rule. And part of his 11 question was that if the staff is reviewing an 12 application according to the current GEIS, I'm 13 assuming he meant the 2013 GEIS. And with respect to 14 that question, you said the staff would continue to 15 review against the current GEIS.

16 I'd like to give you two cases and ask you 17 to respond more directly to his question. One case is 18 initial license renewal and the second case is 19 subsequent license renewal. If the staff is currently 20 reviewing an environmental report for initial license 21 renewal, then you would be using the 2013 GEIS 22 currently. So what would happen once the new rule 23 goes into effect? Will you hold the applicant after 24 that one year compliance period to adjust its ER to 25

2024? And also, with respect to subsequent license 2

renewal, if you're currently reviewing an application 3

that has a site-specific environmental report, once 4

the GEIS comes out and specifically addresses SLR, 5

will you shift to reviewing it against the new GEIS or 6

will you continue the site-specific evaluation?

7 DR. HOLAHAN: This is Trish Holahan.

8 Thanks for that clarification. Initial license 9

renewal applications that are already under review and 10 that rely upon the 2013 GEIS would need to be updated 11 after the 2024 GEIS is issued by the compliance date 12 such as by issuing a supplement to the draft or the 13 final GEIS or addressing the revised GEIS in the final 14 EIS and/or in the record of decision because it's 15 incumbent upon the staff within 30 days to make sure 16 that they're compliant with the regulations.

17 For subsequent license renewal in CLI 18 03, the Commission order, the Commission allowed SLR 19 applicants to submit an environmental report in which 20 they evaluate on a

site-specific basis the 21 environmental impacts previously dispositioned as to 22 the Category 1 issues.

23 After the LR GEIS and rule becomes 24 effective, the applicant could either choose to rely 25

(202) 234-4433 WASHINGTON, D.C. 20005-3701 (202) 234-4433 upon the generic conclusions in the 2024 GEIS or they 1

could continue to develop the site-specific EIS. When 2

developing a site-specific EIS, however, the staff 3

would need to discuss any new and significant 4

information related to the SLR application that's 5

contained in the 2024 GEIS.

6 Does that clarify your question?

7 MR. TURK: Thank you. I think that was 8

very useful.

9 MS. RONEWICZ: Okay, we do have Maxwell 10 Smith. You may go ahead, please.

11 MR. SMITH: Hi, this is Max Smith also 12 from the Office of General Counsel. I just wanted to 13 say Trish made a great point there in response to 14 Ryan's good question. I'd also want to add in for 15 context that the effective date and the compliance 16 date in this rule match what was done back in 2013, so 17 the previous revision of the GEIS also had an 18 effective date of 30 days and a compliance date of 19 matching this current one.

20 So I think if you're kind of confused or 21 have questions about it, you can go back and look at 22 the previous implementation of the last provision of 23 the GEIS and the intent here is to kind of follow that 24 and do it with some less time with you. The obvious 25

with it, both initial and subsequent license renewals, 2

the idea here is basically to match with the last GEIS 3

update.

4 MS. RONEWICZ: Thanks, Max, for that 5

information. And we have Amy Aughtman. Please go 6

ahead, Amy.

7 MS. AUGHTMAN: Thank you. This is Amy 8

Aughtman with Southern Nuclear. And just to follow up 9

on the question from Rachel Turney-Work and Kevin 10 Folk's response to that, I think what I understand 11 Kevin's response was that paragraph Q or Quebec is 12 being removed from the rule, but the references to 13 climate change as a Category 2 issue is planned to 14 remain in Table B-1.

15 MR. FOLK: Yes, this is Kevin Folk of 16 staff. That's essentially correct. We are not 17 removing Q as in Quebec. We are proposing to modify 18 that text to eliminate the reference to mitigation 19 measures and greenhouse gases and climate change 20 impacts on environmental resources would remain in B-1 21 as Category 1 and Category 2 issues, respectively.

22 MS. AUGHTMAN: By chance, do you have the 23 new paragraph Quebec that you could read?

24 MR. FOLK: We don't have that available 25

2 MR. FOLK: The draft final rule will be 3

publicly available on or about ten days from the time 4

it goes to the Commission.

5 MS. AUGHTMAN: Okay. Thank you.

6 MS. RONEWICZ: Okay and then we have a 7

question from Martin O'Neill. Please go ahead, 8

Martin.

9 MR. O'NEILL: Yes, this is Martin O'Neill, 10 Associate General Counsel for Nuclear Energy 11 Institute.

And I

just wanted to seek some 12 clarification on like one of Trish's comments there 13 you mentioned I think maybe in the case of an initial 14 license renewal application, the potential need for 15 supplement the ER, you know, to account for the new 16 license renewal GEIS and new rule. I mean I guess 17 wouldn't that be one potential option? And I'm 18 thinking that, you know, another possibility might be 19 RAIs from the staff to which the applicant responds 20 and then I'd also note I'm aware of a couple of cases 21 including the draft SEIS for Comanche Peak, where the 22 staff has essentially done a gap analysis. Is that 23 another potential option that would really obviate the 24 need for an ER supplement?

1 MR. O'NEILL: And is that an approach that 2

the staff may continue to use moving forward, you 3

know, with additional applications whether it's 4

initial or subsequent license renewal? I'm referring 5

to -- I think it's like Appendix G in the Comanche 6

Peak draft SEIS. I think there might be one in the 7

13 MR. O'NEILL: Thanks. Yes, it just 14 appears that the staff already is anticipating 15 potential deltas between current GEIS and rule and 16 future one and are proactively trying to address that 17 in some cases. Right? That's a fair statement?
