Dear Louis Brayboy:

We have reviewed the proposed revisions to the North Carolina Radiation Protection Rules, 10A NCAC 15.0301-.0310, received by our office on October 16, 2023. These regulations were reviewed by comparison to the equivalent U.S. Nuclear Regulatory Commission (NRC) rules and the requirements of Chapter 10 Code of Federal Regulations (CFR) Parts 30, 31, 32, 33, 35, 36, 40, and 70 as identified in the enclosed State Regulation Status (SRS) Data Sheet. We discussed our review of the regulations with you on December 13, 2023.

As a result of our review, we have three comments that have been identified in Enclosure 1.

Please note that we have limited our review to regulations required for compatibility and/or health and safety. Under our current procedure, a finding that the North Carolina regulations meet the compatibility and health and safety categories of the equivalent NRC regulation may only be made based on a review of the final North Carolina regulations. However, we have determined that if your proposed regulations were adopted, incorporating our comments and without other significant change, they would meet the compatibility and health and safety categories established in the Office of Nuclear Material Safety and Safeguards (NMSS)

Procedure SA-200, Compatibility Categories and Health and Safety Identification for NRC Regulations and Other Program Elements.

We request that when the proposed regulations are adopted and published as final regulations, a copy of the as published regulations be provided to us for review. As requested in NMSS Procedure SA-201, Review of State Regulatory Requirements, please highlight the final changes and provide a copy to Division of Materials Safety, Security, State, and Tribal Programs, NMSS.

The SRS Data Sheet in Enclosure 2 summarizes our knowledge of the status of other North Carolina regulations, as indicated. Please let us know if you note any inaccuracies or have any comments on the information contained in the SRS Data Sheet. Compatibility A, B, C, D, H&S North Carolina needs to add language similar to the following to 10 NCAC 15.0301, 15.0302, 15.0304, 15.0305, 15.0307, 15.0308, 15.0309, 15. 0310.

To reconcile differences between this regulation and the incorporated sections of Federal regulations and to effectuate their joint enforcement, the following words and phrases shall be substituted for the language of the Federal regulations:

1) With the exception of 10 CFR 30.4 and in the definition of Special Nuclear Material, a reference to NRC or Commission means the North Carolina Department of Health and Human Services

[or similar designation].

2) A reference to NRC or agreement state means the North Carolina Department of Health and Human Services

[or similar designation], NRC, or agreement state.

3) A reference to the Act means a reference to North Carolina statute [insert appropriate reference].
4) In 10 CFR 40.4, in the definition of Special Nuclear Material, the sentence and any other material which the Commission, pursuant to the provisions of section 51 of the Act, determines to be special nuclear material, remains preserved.
5) In 10 CFR 30.18(d), 30.32(g),

31.5(b)(1)(ii), 31.5(c)(3)(ii),

31.5(c)(8)(i), 31.6, 31.7(a),

North Carolina needs to change 10 A NCAC 15.0301(a)(3) to read 10 CFR 30.3, Activities requiring license; except sections (b)(1), (b)(2), and (b)(3) and references to 30.3 (b)(1),

(b)(2) and (b)(3) shall not apply. This change is necessary in order to meet the category NRC designation assigned to 10 CFR 30.3(b)(1), (b)(2),

and (b)(3).

3 STATE SECTION NRC SECTION RATS ID CATEGORY SUBJECT and COMMENTS North Carolina has a typo in their adoption by reference resulting in a non-existent regulation being cited.

North Carolina needs to amend 10A NCAC 15.0307(k)(13) to cite 10 CFR 35.2204 as opposed to 35.2203 in order to meet the category D designation assigned to 10 CFR 35.2204.
