By letter dated June 29, 2023 (Agencywide Documents Access and Management System (ADAMS)
Accession No. ML23180A151), NuScale Power LLC (NuScale) submitted a request for exemption to the reporting requirements of 10 CFR 50.46(a)(3) for the US600 Design Certification (DC). The proposed exemption to 10 CFR 50.46(a)(3) would defer reporting of changes to or errors in an acceptable evaluation model (EM) unless and until that EM, the DC or associated standard design approval is incorporated in a license application.
On July 28, 2023 (ADAMS Accession No. ML23209A778), the NRC notified NuScale via email of the results of the NRC staffs acceptance review of this exemption request. NuScale had requested NRC staffs approval of this exemption request within 60 days of the date of transmittal. The NRC staff notified NuScale they intended to complete this licensing action by September 1, 2023 and that this licensing request would take approximately 90 hours0.00104 days <br />0.025 hours <br />1.488095e-4 weeks <br />3.4245e-5 months <br /> to complete..
During subsequent discussions with NuScale, NuScale indicated verbally that the 60 day approval timeline was no longer necessary. In order to allow for additional interactions with NuScale on the exemption request, which include a public meeting held on November 16, 2023, the schedule for completion of the exemption evaluation has been extended. A new schedule was discussed with Elisa Fairbanks on November 16, 2023 and calls for the staff to complete the licensing request by January 31, 2024. The staff will not require any additional hours to complete the review.
