ACKNOWLEDGEMENT OF RESPONSE TO NRC INSPECTION REPORT
05000237/2023011 AND 05000249/2023011 AND DISPUTED NON-CITED
VIOLATION
Dear Patrick Boyle:
This letter acknowledges your October 6, 2023, correspondence (Agencywide Document and
Access Management System (ADAMS) Accession No. ML23279A071) sent in response to
U.S. NRC Inspection Report 05000237/2023011 and 05000249/2023011 (ML23242A188) dated
September 6, 2023. In your letter, you dispute one non-cited violation (NCV 05000237,05000249/2023011-01) associated with the failure to assure a condition adverse to quality was
corrected. Specifically, the report asserted that corrective actions for a 2020 test control
violation did not correct a violation issued in Inspection Report 05000237/2020001;
05000249/2020001 (ML20133J811). The NRC is currently reviewing your basis for contesting
the violation in accordance with Section 2.8 of the Enforcement Manual. Accordingly, we will
provide the results of our evaluation by written response upon completion of our review.
