SUMMARY

OF AUGUST 8, 2023, PRESUBMITTAL MEETING WITH VISTRA OPERATIONS COMPANY LLC TO DISCUSS PROPOSED LICENSE AMENDMENT REQUEST TO EXTEND THE DIESEL GENERATOR ALLOWED OUTAGE TIME FROM 3 DAYS TO 14 DAYS (EPID L-2023-LRM-0053)

On August 8, 2023, an Observation public meeting was held between the U.S. Nuclear Regulatory Commission (NRC) staff and representatives of Vistra Operations Company LLC (the licensee) via webinar. The purpose of the meeting was to discuss a proposed license amendment request to extend the diesel generator (DG) allowed outage time from 3 days to 14 days when alternate power generators (APGs) are available at the Comanche Peak Nuclear Power Plant, Unit Nos. 1 and 2 (Comanche Peak Units 1 and 2). The meeting notice and agenda, dated July 26, 2023, are available in the Agencywide Documents Access and Management System (ADAMS) at Accession No. ML23207A170. A list of attendees is enclosed.

The licensee presented informational slides at the meeting, which can be found in ADAMS at Accession No. ML23215A165. During the meeting, the licensee discussed a proposed change to Technical Specification (TS) 3.8.1, AC [Alternating Current] Sources - Operating, Condition B, One DG inoperable, to add a new 14-day completion time to restore the DG to operable status when APGs are available to the existing 72-hour completion time and the use of the risk-informed completion time (RICT) program. The licensee stated the reasons for the change is to move DG maintenance from refueling outages to at-power operations to provide more flexibility in outage scheduling while maintaining defense in depth throughout the outage.

The licensee further stated that the risk from routine DG maintenance would not be accumulated against the RICT rolling 12-month incremental risk allowance, allowing more cumulative risk to address emergent issues, while somewhat increasing the baseline risk for Comanche Peak.

The licensee stated that the proposed change was developed using the guidelines of NUREG-0800, Standard Review Plan for the Review of Safety Analysis Reports for Nuclear Power Plants: LWR [Light-Water Reactor] Edition, Branch Technical Position (BTP) 8-8, Onsite (Emergency Diesel Generators) and Offsite Power Sources Allowed Outage Time Extensions (ML113640138). The licensee stated that compensatory actions consistent with BTP 8-8 will be taken when using the 14-day allowed outage time.

The NRC staff discussed several observations on the licensee presentation, including the format of the revised TSs and the interface between the proposed allowed outage time and the RICT program.

No members of the public called into the meeting. No public meeting feedback forms were received. No regulatory decisions were made at the meeting.
