OKLAHOMA FINAL REVISIONS TO RATS ID 2019-1, 2019-2, 2020-1, 2020-2, AND 2020-3

Dear Keisha Cornelius:

We have reviewed the final revisions to the Oklahoma regulations OAC 252:410-10-34, 252:410-10-35, 252:410-10-36,252:410-10-37, 252:410-10-40, 252:410-10-71, and 252:410-10 received by our office on July 7, 2023. These regulations were reviewed by comparison to the equivalent U.S. Nuclear Regulatory Commission (NRC) rules and the requirements of Regulation Amendment Tracking System Identification Number(s) (RATS ID) 2019-1, 2019-2, 2020-1, 2020-2 and 2020-3 as identified in the enclosed State Regulation Status (SRS) Data Sheet. We discussed our review of the regulations with you on October 3, 2023.

As a result of our review, we have six comments that have been identified in Enclosure 1.

Specifically, during our review we identified several areas of potential confusion related to Oklahomas incorporation of NRC requirements by reference. We recognize that the NRC did not identify these issues when Oklahoma first incorporated NRC regulations by reference.

However, these changes are required for compatibility and/or health and safety. We have determined that if these regulations are revised, incorporating our comments and without other significant change, they would meet the compatibility and health and safety categories established in the Office of Nuclear Material Safety and Safeguards (NMSS) Procedure SA-200, Compatibility Categories and Health and Safety Identification for NRC Regulations and Other Program Elements.

We request that when you revise your regulations to address our comments, a copy of the as published regulations be provided to us for review. As requested in NMSS Procedure SA-201, Review of State Regulatory Requirements, please highlight the location of any changes made and provide a copy to Division of Materials Safety, Security, State, and Tribal Programs, NMSS.

The SRS Data Sheet in Enclosure 2 summarizes our knowledge of the status of other Oklahoma regulations, as indicated. Please let us know if you note any inaccuracies or have any comments on the information contained in the SRS Data Sheet. 252:410 30(1)(D) 10 CFR 30.4 Definitions In 252:410-10-1(b)(2) Oklahoma appropriately excludes from incorporation by reference the following two definitions in 10 CFR 30.4 that are Compatibility Category NRC:

The second paragraph of the definition of Commencement of Construction

Paragraph (9)(ii) of the definition of Construction However, in 252:410-10-30(1)(D) it appears Oklahoma incorporates all of 10 CFR 30.4 -

Definitions, by reference.

To prevent confusion, Oklahoma should revise 252:410-10-30(1)(D) to make clear that the incorporation by reference of 30.4 is subject to the exclusions in 252:410-10-1(b)(2). Oklahoma may accomplish this by revising 252:410 30(1)(D) as follows:

(D) 30.4 - Definitions, except for those listed in 252:410-10-1(b)(2)

Additionally, to improve clarity, Oklahoma should remove "Quantities of concern" from 252:410-10-1(b)(2) as the NRC removed that definition from 10 CFR 30.1 in 2014 (79 FR 58664).

Oklahoma should clarify that reference to the Act in incorporated NRC regulations means a reference to Oklahoma statute 3

252:410-10-1 Part 30, 31, 32, 40 N/A Oklahoma should make clear that certain requirements related to the transfer of material apply to both other Agreement State licensees as well as the NRC licensees.

Specifically, in 10 CFR 30.18(d), 30.32(g),

31.5(b)(1)(ii), 31.5(c)(3)(ii), 31.5(c)(8)(i), 31.6, 31.7(a), 31.10(a), 31.10(b)(1), 31.12(c)(4),

32.13, 32.51(a), 32.51(c), 32.56, 32.59,

2 32.72(b)(5)(ii), 40.13(c)(10), 40.22(e), 40.25(b),

40.25(d)(3), 40.54, 40.55(c), (c)(1), (d)(1)(ii),

(d)(2) and (d)(3), all of which Oklahoma incorporates by reference, reference to an Agreement State should mean reference to an Agreement State or the NRC.

Oklahoma may address this by revising 252:410-10-2(b) to add a new paragraph (8) that reads as follows:

To address this, Oklahoma should:

Revise 252:410-10-70(3)(B) to read:

70.19 - General license for calibration or reference sources. In 10 CFR 70.19(a)

In 10 CFR 150.20, where the words non-agreement states, areas of exclusive federal jurisdiction within agreement states, or offshore waters are used in 150.20(a)(1)(i), (ii), (iii), (b),

(b)(3), and (b)(4) substitute the words the State of Oklahoma.

Where the words agreement state license are used in 10 CFR 150.20, also add the words Nuclear Regulatory Commission license.

Where the words license issued by an agreement state are used in 10 CFR 150.20 also add the words license issued by the Nuclear Regulatory Commission.

Where the words license from an agreement state are used in 10 CFR 150.20 also add the words license from the Nuclear Regulatory Commission.

6 252:410 31(2)(C) 10 CFR 31.6 N/A In 252:410-10-31(2)(b) Oklahoma incorporates 10 CFR 31.6 by reference. However, Oklahoma should make clear that in incorporating 10 CFR 31.6, the terms to any non-agreement state or offshore waters should mean the State of Oklahoma.
