SUMMARY

OF JUNE 28, 2023, MEETING WITH FLORIDA POWER AND LIGHT/NEXTERA TO DISCUSS A TURKEY POINT PLANNED LICENSE AMENDMENT REQUEST TO TRANSITI ON TO A 24-MONTH FUEL CYCLE (EPID NO. L-2023-LRM-0042)

On June 28, 2023, a virtual observation public meeting was held between the U.S. Nuclear Regulatory Commission (NRC) and representativ es of Florida Power and Light/NextEra (FPL, the licensee). The purpose of the meeting was to discuss planned license amendment requests (LARs) for the Turkey Point Nuclear Generating Unit Nos. 3 and 4 (Turkey Point) to transition to a 24-month fuel cycle. The licensee also plans to submit another LAR which modifies the spent fuel pool criticality analysis in support of transition to a 24-month fuel cycle. The meeting notice and agenda, dated June 15, 2023, are available in the Agencywide Documents Access and Management System (ADAMS) Accession No. M L23177A220. A list of attendees is provided in the enclosure.

The licensee presented (ML23177A081) and discussed the following:

Spent Fuel Pool (SFP) Criticality Analysis LAR o New analysis will supersede current analysis.

o Fuel design changes:

ADOPT fuel pellets AXIOM fuel cladding PRIME advanced fuel features o Depletion parameter changes o Guidance in Nuclear Energy Institute (NEI) 12-16, Revision, as endorsed by NRC Regulatory Guide (RG) 1.240, Revision 0, Fresh and Spent Fuel Pool Criticality Analysis o Methodology:

Exceptions from NEI 12-16, Revision Checklist o Criticality Fuel Designs o SFP storage design o Absorber Monitoring Programs:

Metamic inserts Boral crediting in cask area racks 18 to 24 Month Fuel Cycle Transition LAR:

o Technical Specification (TS) changes o Updated Final Safety Analysis Report (UFSAR) changes o Surveillance Frequency Extension Method:

Use of NRC Generic Letter (GL), 91-04, Changes in Technical Specification Surveillance Intervals to Accommodate a 24-Month Fuel Cycle Upgrade of non-Extended Power Uprate (EPU) Reactor Trip System (RTS) and Engineered Safety Feature Actuation System (ESFAS) functions Calibration Surveillance Requirement (SR) loop uncertainties will be determined for 24 months plus 25% grace Evaluation of non-calibration SRs Will revise, as necessary, Nominal Trip Setpoints and/or Allowable Values impacted by revised loop uncertainty calculations.

Proposed Schedule of LARs o Submittal of LAR in August 2023 o Requested approval in September 2024 o Implementation in Spring 2025 for Unit 4 and Spring 2026 for Unit 3

The NRC staff had the following questions and feedback:

You stated that thimbles are only inserted for a short amount of time, what are they used for?

Will the French Haut Taux de Combustion (HTC) critical experiments data report be able to be utilized in your application? Will there be a new non-disclosure agreement (NDA) to use this report?

What contingencies do you have if the NRC cannot approve the amendments in the time you request?

Are there different set of requirements for each of the three categories of fuel designs (slide 10)?

Are there different equations for each region for each fuel design?

Licensee should review human factors impacts for the change in fuel storage with the three fuel designs.

Will the No Significant Hazards Considerations (NSHC) be affected? The staff provided feedback that the licensee should be mindful to address why the proposed change is not a significant increase for the questions in the NSHC.

Why are arrays IIb and c pictures different (right picture has fuel with insert next to each other vs left picture where mirrored?

Do the metamic inserts get removed from the pool? How are they used?

Are you redoing all the accident analyses in the updated final safety analysis report (USFAR)?

Are you keeping all current methodizes for the existing accident analyses the same, besides rod ejection?

Are there any substantial changes to the licensing bases with any accident analyses?

Are you including the ADOPT fuel topical report in the COLR list? Will it be in Technical Specification (TS) 4.2.1?

Is there a drop dead date for approval of the LAR?

What information for this change will be submitted in the LAR related to any setpoint methodology changes?

Will the license be adopting technical specification task force (TSTF) change traveler 493?

How are you using computer programs PARAGON and SCALE?

Concerns about the complexity of the review, given the first-of-a-kind use of fuel and cladding technologies being used, paired with a tight review schedule were discussed by the NRC staff. The licensee stated that fuel will need to be purchased from the vendor prior to the currently scheduled review completion date of September 2024 in order for the methodology to be implemented at Turkey Point Nuclear Generating Unit 4 during the spring 2025 outage. The licensee stated that the commercial and monetary risks associated with this plan are understood.
