Dear David Lawrenz:

We have reviewed the proposed revisions to the Kansas Radiological Health Regulations, received by our office on April 12, 2023. These regulations were reviewed by comparison to the equivalent U.S. Nuclear Regulatory Commission (NRC) rules and the requirements of Regulation Amendment Tracking System Identification Number(s) (RATS ID) 2007-3 and 2015-3 as identified in the enclosed State Regulation Status (SRS) Data Sheet. We discussed our review of the regulations with you on July 10, 2023.

As a result of our review, we have seven comments that have been identified in the. Please note that we have limited our review to regulations required for compatibility and/or health and safety. Under our current procedure, a finding that the Kansas regulations meet the compatibility and health and safety categories of the equivalent NRC regulation may only be made based on a review of the final Kansas regulations. However, we have determined that if your proposed regulations were adopted, incorporating our comments and without other significant change, they would meet the compatibility and health and safety categories established in the Office of Nuclear Material Safety and Safeguards (NMSS)

Procedure SA-200, Compatibility Categories and Health and Safety Identification for NRC Regulations and Other Program Elements.

We request that when the proposed regulations are adopted and published as final regulations, a copy of the as published regulations be provided to us for review. As requested in NMSS Procedure SA-201, Review of State Regulatory Requirements, please highlight the final changes, and provide a copy to Division of Materials Safety, Security, State, and Tribal Programs, NMSS.

The SRS Data Sheet in Enclosure 2 summarizes our knowledge of the status of other Kansas regulations, as indicated. Please let us know if you note any inaccuracies, or have any comments on the information contained in the SRS Data Sheet. Terms and conditions of licenses Kansas needs to replace the reference to §28-35-181m(h) in

Kansas needs correct the reference in

§28-35-181m(i)(2) as stated above to meet the Category B designation assigned to 10 CFR 30.34(j).

§28 135l(p) 71.4 2015-3 B

Definitions

1) Kansas needs to remove the and at the end of §28-35-135l(p)(D)(2)(B).
2) Kansas needs to change the wording of §28-35-135l(p)(D)(3) to accurately reflect the requirements of 71.4. The current wording states that only consolidated wastes and activated materials must meet the requirements of 10 CFR 71.77 and that excluded powders must meet the requirements in (3)(A)-(C) but it is all group III solids that must meet the requirements in 71.77 and in (3)(A)-

(C). Kansas needs to change §28 135l(p)(D)(3) to read:

group III solids, including consolidated wastes and activated materials but excluding powders, that meet the requirements of 10 C.F.R. 71.77 and meet the following conditions:

3) Kansas §28-35-135l(p)(D)(3)(B) needs to change or to and Kansas needs to make these corrections in order to meet the Compatibility Category B designation assigned to 10 CFR 71.4, Definition of Low Specific Activity (LSA) material.

§28-35-500 71.17 2015-3 B

General license: NRC approved package

1) Kansas references part 15 of their regulations in §28-35-500(c)(2) rather than 10 CFR Part 71 subparts A, G, and H. Kansas provided that part 15 refers to §28-35-500 through §28 505. The review notes that 10 CFR Part 71 subpart H has been adopted by reference but Kansas has not adopted the required sections of 10 CFR Part 71 subpart A and only some of the required sections of 10 CFR Part 71 subpart G. The review also notes that is is unclear how a reader of the requirements would know what part 15 refers to.

Kansas needs to either adopt the applicable sections of 10 CFR 71 subparts A and G by reference, or otherwise submit equivalent regulations to those subparts.

Additionally, Kansas needs to make it clear to the reader of the regulations on the Kansas Secretary of States website what sections are covered under part 15.

2) Kansas needs to add as satisfying the provisions of § 28-35-505 at the end of § 28-35-500(b).
3) Kansas needs to remove the reference to K.A.R. 28-35-501 in

§ 28-35-500(e) and replace it with 10 CFR 71.19 since 71.19 is Category NRC and cannot be replaced with a Kansas regulation.

Kansas needs to make these corrections to meet the Compatibility Category B designation assigned to 10 CFR 71.17 4

§28-35-500a 71.21 2015-3 B

General license: Use of foreign

1) Kansas references part 15 of their regulations in §28-35-500a(b)(2) rather than 10 CFR Part 71 subparts A, G, and H. Kansas provided that part 15 refers to §28-35-500 through

§28-35-505. The review notes that 10 CFR Part 71 subpart H has been adopted by reference but Kansas has not adopted the required sections of 10 CFR Part 71 subpart A and only some of the required sections of 10 CFR Part 71 subpart G.

Additionally, Kansas needs to make it clear to the reader of the regulations on the Kansas Secretary of States website what sections are covered under part 15.

1) 28-35-501 is the equivalent of 10 CFR 71.19, which is Category NRC.

Kansas needs to delete 28-35-501 from its regulations.

Kansas needs to make this correction to meet the Compatibility Category NRC designation assigned to 10 CFR 71.19.

1) Kansas needs to revise the intro paragraph of 28-35-181m(h) to add the bolded language as follows: for medical use under part 6 of these regulations or equivalent NRC or agreement state requirements Additionally, Kansas needs to make it clear to the reader of the regulations on the Kansas Secretary of States website what sections are covered under part 6.
2) Kansas needs to revise 28 181m(h)(4) to read as follows the information identified in 28 181m(d)(1)-(3) on the PET drugs to be noncommercially transferred to members of its consortium.

Kansas needs make these corrections to meet the compatibility category B designation of 30.32(j).

7 28-35-181m 32.72 NA B

Manufacture, preparation, or transfer for commercial distribution of radioactive drugs containing byproduct material for medical use

1) Kansas needs to revise 28 181m(d)(2) to read essentially identifcal to the following: the maximum activity per vial, syringe, generator, or other container of the radioactive drug; and
2) Kansas needs to revise 28 181m(d)(3) to read essentially identical to the following: the shielding provided by the packaging to show it is appropriate for the safe handling and storage of the radioactive drugs by medical use licensees.

3) Kansas needs to replace at least one of the following conditions is met with both of the following conditions are met in the intro of 28 181m(f)(4).

5) Kansas needs to revise 28 181m(f)(5)(D) to read NRC master materials permittee of broad scope or
6) Kansas needs to revise 28 181m(f)(5)(E) to remove the statement as permitted by 10 CFR 35.13(b)(5)
7) Kansas is missing the subsection equivalent to 32.72(d), the State needs to add this subsection.

Kansas needs make these corrections to meet the compatibility category B designation of 32.72.
