Dear Michael Snee:

We have reviewed the final revisions to the Ohio Adm. Code 3701 Chapter 1 Rules (Ohio Regulations) Sections 37-01, 37-08, 37-10, 37-15, 37-25, 37-26, 50-23, 50-25, 56-04, 58-18, 58-20, 58-21, 58-40, 58-51, 58-71,58-101, and 58-102, received by our office on May 19, 2023.

These regulations were reviewed by comparison to the equivalent U.S. Nuclear Regulatory Commission (NRC) rules and Regulation Amendment Tracking System Identification Numbers (RATS ID) 2018-3, 2019-1, 2020-2, 2020-3, 2021-1, and 2021-2 as identified in the enclosed State Regulation Status (SRS) Data Sheet. We discussed our review of the regulations with you on July 17, 2023.

As a result of our review, we have two comments that have been identified in Enclosure 1.

Please note that we have limited our review to regulations required for compatibility and/or health and safety. We have determined that if these regulations are revised, incorporating our comments and without other significant change, they would meet the compatibility and health and safety categories established in the Office of Nuclear Material Safety and Safeguards (NMSS) Procedure SA-200, Compatibility Categories and Health and Safety Identification for NRC Regulations and Other Program Elements.

We request that when you revise your regulations to address our comments, a copy of the as published regulations be provided to us for review. As requested in NMSS Procedure SA-201, Review of State Regulatory Requirements, please highlight the location of any changes made and provide a copy to Division of Materials Safety, Security, State, and Tribal Programs, NMSS.

The SRS Data Sheet in Enclosure 2 summarizes our knowledge of the status of other Ohio regulations, as indicated. Please let us know if you note any inaccuracies or have any comments on the information contained in the SRS Data Sheet. Advance notification of shipment of category I quantities of radioactive material Ohio has omitted having the advance notification required by 37-26(A)(1) go to their director.

Ohio needs to revise the first sentence of 37-26(A)(1) to read The notification must be made to the director and to the office of each appropriate governor (underlined to show added text).

2 3701:1 04 10 CFR 70.32(a)(9)(i)(C) 2021-1 H&S Conditions of Licenses Ohio has omitted requirements for the reporting by certain licensee affiliates, as defined in 11 U.S.C. 101(2).

Ohio needs to revise its definition of affiliate in OH 3701:1-56-04(B)(3) to include the provisions 11 U.S.C.

101(2)(B), (C), and (D) to meet the Category H&S designation assigned to 10 CFR 70.32(a)(9)(i)(C).

Ohios omission of the full definition of the term affiliate does not meet the essential objective 10 CFR 70.32(a)(9) because by excluding the definition of corporations, persons, and entities as referenced in 10 CFR 70.32(a)(9)(i)(C) and defined in 11 U.S.C 101(2) the omission could prevent certain bankruptcy filings from being reported to the State Director.
