We have reviewed the proposed revisions to the Arkansas State Board of Healths Rules for Control of Sources of Ionizing Radiation received by our office on May 10, 2023. These regulations were reviewed by comparison to the equivalent U.S. Nuclear Regulatory Commission (NRC) rules and the requirements of Regulation Amendment Tracking System Identification Number(s) (RATS ID) 2015-3, 2015-4, 2019-2, 2020-1, 2020-2, 2020-3, 2021-1, and 2021-2 as identified in the enclosed State Regulation Status (SRS) Data Sheet. We discussed our review of the regulations with you on August 10, 2023.

As a result of our review, we have six compatibility comments and one editorial comment that have been identified in Enclosure 1. Please note that we have limited our review to regulations required for compatibility and/or health and safety. Under our current procedure, a finding that the Arkansas regulations meet the compatibility and health and safety categories of the equivalent NRC regulation may only be made based on a review of the final Arkansas regulations. However, we have determined that if your proposed regulations were adopted, incorporating our comments and without other significant change, they would meet the compatibility and health and safety categories established in the Office of Nuclear Material Safety and Safeguards (NMSS) Procedure SA-200, Compatibility Categories and Health and Safety Identification for NRC Regulations and Other Program Elements.

We request that when the proposed regulations are adopted and published as final regulations, a copy of the as published regulations be provided to us for review. As requested in NMSS Procedure SA-201, Review of State Regulatory Requirements, please highlight the final changes, and provide a copy to Division of Materials Safety, Security, State, and Tribal Programs, NMSS.

The SRS Data Sheet in Enclosure 2 summarizes our knowledge of the status of other Arkansas regulations, as indicated. Please let us know if you note any inaccuracies or have any comments on the information contained in the SRS Data Sheet. AR added the phrase persons in paragraph a. receiving source material shall retain each record of transfer for this material until the Department terminates each license to RH-600.a.2. As written, ARs regulation is less restrictive than 40.61(a)(2) because it does not include byproduct material.

Additionally, AR deleted the phrase unless a specific requirement in another part of these Regulations dictates otherwise, from RH-600.a.2.

Since RH-600.a.2 is also applicable to material licensed under Part 30, the omission of this phrase makes RH-600.a.2 less restrictive than 10 CFR 30.51(a)(2).

AR should consider using the CRCPD suggest state regulations to revising RH-600.a.2 to state, [T]he licensee who transferred the material shall retain each record of transfer until the Department terminates each license that authorizes the activity that is subject to the recordkeeping requirement."

AR needs to make these changes in order to meet the Compatibility Category C designation assigned to 10 CFR 41.61(a)(2) and 10 CFR 30.51(a)(2).

2 RH- 40.22(b)(3) NA B Small quantities of source material 401.a.2.C AR did not include the equivalent to 10 CFR 40.3 in the list of provisions in RH-401.a.2.C. AR needs to include its equivalent of 10 CFR 40.3 in RH-401.a.2.C.

STATE SECTION NRC SECTION RATS ID CATEGORY SUBJECT and COMMENTS AR incorporated three provisions in RH-401.a.2.C that are not in 10 CFR 40.22(b)(3). AR needs to delete Part E of Section 2, RH-751, and Section 4 from the list of provisions in RH-401.a.2.C.

AR needs to make these changes in order to meet the Compatibility Category B designation assigned to 10 CFR 40.22(b)(3).

3 RH-401.c.6 40.25(e) NA C General license for use of certain industrial products or devices AR added a new subsection that lists the equivalent provisions from the terms and conditions for 10 CFR Part 31 in RH-401.c.6. However, RH-401.c.6 is an equivalent to a 10 CFR Part 40 requirement. The terms and conditions in 10 CFR Part 31 do not apply to Part 40. Therefore, AR needs to delete subsection RH-401.c.6.

AR needs to make this change in order to meet the Compatibility Category C designation assigned to 10 CFR 40.25.

4 RH-402.a 31.5 NA C Certain Detecting, measuring, gauging, or controlling devices and certain devices for producing light or an ionized atmosphere AR needs to revise the first sentence of RH-402.a to delete Federal government agencies from the list of entities a general license is issued to, since all federal entities are under the purview of the NRC.

AR needs to make this change in order to meet the Compatibility Category C designation assigned to 10 CFR 31.5.

EDITORIAL COMMENTS ON ARKANSAS PROPOSED REGULATIONS STATE SECTION NRC SECTION RATS ID CATEGORY SUBJECT and COMMENTS 1 RH-751 20.2302 NA D RH-751, Section 2, which is equivalent to 10 CFR 20.2302, is the only Part 20 requirement that is not located in Section 3. As noted in the compatibility comments above, this structure of the AR regulations is causing compatibility issues.

To resolve these issues, it is recommended that AR do one of the following: (1) move the requirement contained in RH-751 to Section 3; (2) reference RH-751 together with Section 3, as applicable; or (3) remove RH-751 entirely as 10 CFR 20.2302 is Compatibility Category D.

If RH-751 is not relocated to Section 3, AR needs to look through their regulations to determine if RH-751 needs to be added or deleted from the individual regulatory provision.
