Reference:

Letter BWXT Advanced Technologies, LLC (Miller) to NRC (Lubinski), Notice of Intent to Pursue Authorization to Transport the DOD Pele Prototype Reactor, November 4, 2021. (ATL-LTR-21-0417)

BWXT previously submitted a Notice of Intent to Pursue Authorization to Transport the DOD Pele Prototype Reactor. The purpose of this letter is to provide an update on the licensing path forward and align administratively on the process.

1. BWXT has contracted with NAC International, Inc., who will be the Applicant and will perform any necessary design analysis, risk assessments, testing, and Safety Analysis Report development to support the application.

2. BWXT will continue to perform design, purchase, fabrication, handling, shipping, storing, cleaning, assembly, inspection, testing, operation, maintenance, repair, and modification of components of packaging that are important to safety. To that end, BWXT AT will be submitting a Quality Assurance Program Description in accordance with Subpart H of 10 CFR Part 71.

3. The application is expected to be developed in accordance with the Risk Informed Methodology developed by PNNL and currently under review by NRC Staff (ML23066A202).

This methodology development activity is supported by the Government and is independent of the BWXT efforts.

BWXT is the sponsor of 1 & 2 above and as such we expect to receive NRC invoices for the above efforts of BWXT and NAC either directly or through NAC as the applicant, whichever is appropriate under NRC practices.

In addition to the administrative practices above, BWXT hereby provides notice per 10 CFR Part 71.93(c) that we are currently executing long lead procurements and will begin assemb ly at our Lynchburg facility in the coming months. It is unclear at this time whether the future shipment will have a decay heat load over 5 kW or a maximum normal operating pressure over 15 psig. This notice is being provided in the event the criteria are met.

BWXT activities are currently being executed under our NQA-1-2015, 10CFR50 Appendix B, compliant program and will be conducted under the 1 0CFR71 Subpart H program once submitted to the NRC.
