OF APRIL 11, 2023, PUBLIC MEETING ON POTENTIAL OPTIONS FOR PHYSICAL PROTECTION REQUIREMENTS FOR SPENT NUCLEAR FUEL (SNF) AND THE SELF-PROTECTION THRESHOLD On April 11, 2023, staff in NSIR held a public meeting virtually using Microsoft Teams. This meeting was held to engage stakeholders regarding potential revised security regulations for spent nuclear fuel (SNF) and the current external radiation level threshold in the regulations.

The staff held this meeting to inform development of a notation vote paper in response to Commission direction in SRM-SECY-21-0095, Discontinuation of Rulemaking - Enhanced Security of Special Nuclear Material, dated August 4, 2021 (Agencywide Documents Access and Management System (ADAMS) Accession No. ML21217A065).

Members of the U.S. Nuclear Regulatory Commission (NRC) staff provided a presentation, discussing:

The main topics to be addressed in the notation vote paper A. Security for Category II quantities of special nuclear material (SNM)

B. Security for spent nuclear fuel (use and storage / transportation), including the external radiation level threshold exemption (self-protection threshold)

C. Security for alternate nuclear material D.   • The three options currently being considered to address issues surrounding security for SNF and consideration of the exemption, and concurrent outcomes and advantages/disadvantages 1.

Conduct rulemaking: Revise facility and transport security requirements for large SNF storage cask and transportation packages 3.

Conduct rulemaking: Revise threshold in 10 CFR 73.6(b) and conforming requirements Stakeholders were then permitted to ask questions and make comments. Specific issues that were mentioned or discussed in detail included the potential to define the term self-protecting, support from one stakeholder for revising the external radiation level threshold, a recommendation that the staff conduct analysis to support factors mitigating the need to protect non-self-protecting spent fuel at Category I levels, a stakeholders suggestion that staff reconsider its view of physical protection for certain highly dilute material, a question regarding to what level the staff would recommend changing the external radiation level threshold, a question about what large means to the staff in the context of transportation packages, a question about the degree of specificity the staff intended to reference regarding material attractiveness, the potential impact of changes on research and test reactors, a question about potential guidance to be provided to licensees regarding calculation of spent fuels external radiation level, a question about the scope of potential revised requirements, and a question about whether and at what point the notation vote paper would be made public.

There were 95 participants in the public meeting. Participants represented the NRC, the Nuclear Energy Institute, the nuclear industry, other Federal government agencies, and the public. A list of meeting attendees and the meeting agenda are enclosed.
