Dear Mr. Warden:
Enclosed is export application XSNM3834, dated April 2, 2023, received by the U.S. Nuclear Regulatory Commission, from Westinghouse Electric Company LLC, requesting the export of special nuclear material from its fuel fabrication facility in Hopkins, South Carolina to the Haiyang Nuclear Power Plant in China. The requested material is 379,577 kilograms (kg) of uranium, enriched to 4.5% WGT maximum, containing up to 17,227.562 kg of uranium-235, in the form of uranium dioxide pellets encapsulated in sealed fuel rods and fabricated fuel assemblies. The material has Russian and Kazakhstan obligations.
Consistent with the criterion in 10 CFR 110.41(a)(11) and 110.42(a), we would appreciate your views, in accordance with established procedures and from the overall perspective of the Executive Branch, as to whether the requested export meets the applicable criteria in the Atomic Energy Act of 1954, as amended.
