SUMMARY
OF FEBRUARY 28, 2023, PUBLIC MEETING ON POTENTIAL OPTIONS FOR PHYSICAL PROTECTION REQUIREMENTS FOR CATEGORY I AND III QUANTITIES OF SPECIAL NUCLEAR MATERIAL (SNM) AND POTENTIAL OPTIONS FOR PHYSICAL PROTECTION AND MATERIAL CONTROL AND ACCOUNTING (MC&A) FOR ALTERNATE NUCLEAR MATERIAL (ANM)
On February 28, 2023, staff in NSIR held a public meeting virtually using Microsoft Teams. This meeting was held to engage stakeholders regarding potential revised security regulations for Category I and III quantities of SNM and potential physical protection and MC&A requirements for ANM. The staff held this meeting to inform development of a notation vote paper in response to Commission direction in SRM-SECY-21-0095, Discontinuation of Rulemaking - Enhanced Security of Special Nuclear Material, dated August 4, 2021 (Agencywide Documents Access and Management System (ADAMS) Accession No. ML21217A065).
Members of the NRC staff provided a presentation, discussing:
The main topics to be addressed in the notation vote paper A. Security for Category II quantities of SNM B. Security for spent nuclear fuel (use and storage / transportation)
C. Security for alternate nuclear material D. Security for Categories I and III quantities of SNM
Brief explanations of the NRC SNM categorization construct and the SNM attractiveness concept

Conduct rulemaking: Take into account SNM attractiveness for Category 1 facilities, incorporate security measures in security orders and fully consider INFCIRC/225 for Category 3 facilities 3.
Conduct rulemaking: Develop performance-based regulations only for Category 1 quantities of SNM, taking into account security orders and SNM attractiveness
The four options currently being considered to address issues surrounding ANM, and concurrent outcomes and advantages/disadvantages 1.

Defer rulemaking until the NRC receives an application for a reprocessing facility 3.
Conduct rulemaking: Revise regulations to include requirements for physical protection and MC&A for ANM 4.
Conduct rulemaking: Revise regulations to include requirements for physical protection for ANM; defer MC&A aspects until reprocessing application
Tentative schedule for final public meeting on topic B Stakeholders were then permitted to ask questions and make comments. Specific issues that were mentioned or discussed in detail included the extent to which NRC staff provide the public an understanding of security requirements, the need for regulations to combine performance-based and prescriptive requirements, the feasibility of voluntary licensee implementation, the feasibility of non-rulemaking options, the types of facilities and the extent to which potential changes in the regulations would apply (particularly regarding research and test reactors), the rationale for the option of slightly expanding requirements for Category III SNM, support from two stakeholders for staff addressing alternate nuclear material, and a suggestion to publish a transcript of the meeting. Several stakeholders offered opinions regarding the option that should be recommended by the staff.
There were 103 participants in the public meeting. Participants represented the NRC, the Nuclear Energy Institute, the nuclear industry, a state government agency, other Federal government agencies, and the public. A list of meeting attendees and the meeting agenda are enclosed.
