Dear Mark Paulson:
We have reviewed the Wisconsin legally binding requirements received by our office on March 30, 2023. These requirements were reviewed by comparison to the equivalent U.S. Nuclear Regulatory Commission (NRC) rules and the requirements of Regulation Amendment Tracking System Identification Numbers (RATS IDs) 2019-1, 2019-2, 2020-1, 2020-2, 2020-3, 2021-1, and 2021-2 as identified in the enclosed State Regulation Status (SRS)
Data Sheet. We discussed our review of the legally binding requirements with Megan Shober on April 24, 2023.
As a result of our review, we have five comments that have been identified in the enclosure.
Please note that we have limited our review to the legally binding requirements required for compatibility and/or health and safety. We have determined that if these requirements are revised, incorporating our comments and without other significant change, they would meet the compatibility and health and safety categories established in the Office of Nuclear Material Safety and Safeguards (NMSS) Procedure SA-200, Compatibility Categories and Health and Safety Identification for NRC Regulations and Other Program Elements.
We request that when you revise your legally binding requirements to address our comments, a copy of the revised legally binding requirements be provided to us for review. As requested in NMSS Procedure SA-201, Review of State Regulatory Requirements, please highlight the location of any changes made by Wisconsin, in response to our comments, and provide a copy to Division of Materials Safety, Security, State, and Tribal Programs, NMSS.
The SRS Data Sheet summarizes our knowledge of the status of other Wisconsin regulations, as indicated. Wisconsin needs to either add this provision, or incorporate 10 CFR part 71.17(c)(3) by reference, in its license condition to meet the Compatibility Category B designation assigned to 10 CFR 71.17(c)(3).
2 License 35.3047(f)(1)(ii) 2020-2 C Report and notification of a dose to Condition 1 an embryo/fetus or a nursing child
In License Condition 1, Wisconsin cites to 35.3047(g)(1)(ii) instead of (f)(1)(ii).
Wisconsin needs to make the correction noted above to meet the Compatibility Category C designation assigned to 10 CFR 35.3047(f)(1)(ii).
