UPDATE TO THE U.S. NUCLEAR REGULATORY COMMISSIONS TRIBAL PROTOCOL MANUAL.

Dear Chairman Small:

On October 27, 2022, my staff and I met with you and the Fort Hall Business Council of the Shoshone-Bannock Tribes to discuss the U.S. Nuclear Regulatory Commissions (NRCs) potential review of the Carbon Free Power Project (CFPP) Combined License Application. I followed up with a letter to you on November 2, 2022 (Agencywide Documents Access and Management Systems (ADAMS) Accession No. ML22305A706) to express our thanks to you and the members of the Fort Hall Business Council for providing us feedback on NRCs Tribal Protocol Manual (TPM) (ML18214A663).

We have discussed updates to the TPM further within the NRC. We are planning a holistic revision to this important staff guidance document, with consideration of comments from Tribal Nations, integration of Federal best practices, and NRC staff perspectives. In addition to considering the feedback you previously provided, we will solicit further feedback from Tribal Nations and intend to meaningfully engage on the TPM update through government-to-government interactions. This update will be led by the Tribal liaison group within the NRCs Division of Materials Safety, Security, State, and Tribal Programs. Mr. Kevin Williams is the Director of this division; he will be your point of contact for further dialogue on the update. I will continue to engage and be your point of contact regarding the NRCs environmental review of the CFPP application.

I greatly appreciate the opportunity to learn from the Shoshone-Bannock Tribes and look forward to future engagements regarding both the NRCs review of the potential CFPP application and the TPM updates.
