Dear Dr. Brooks,

By letter dated February 7, 2023 (ADAMS Accession No. ML23038A240), the University of Illinois at Urbana-Champaign (UIUC) submitted a topical report titled, University of Illinois Urbana-Champaign High Temperature Gas-cooled Research Reactor: Fuel Qualification Methodology, for review. The U.S. Nuclear Regulatory Commission (NRC) staff is conducting its acceptance review of this topical report. The NRC notes that the topical report was submitted by UIUC under the project no. 99902094 which was created to support activities pertaining to UIUCs pre-application engagement with the NRC for the research reactor planned to be sited at the UIUC campus. The NRC staff understands that this topical report was submitted for review as part of pre-application activities that directly support the anticipated future applications for a construction permit and operating license for a research reactor to be sited at the UIUC campus. The research reactor is expected to use the design developed by Ultra Safe Nuclear Corporation (USNC). During the acceptance review, the NRC staff identified that certain sections of the topical report (e.g.,

Section 1.2, Purpose and Regulatory Request, and Section 6.2, Action Requested) appear to indicate that approval of the methodology and acceptance criteria would be applicable to any license applicant for the USNC design including a power reactor application. The NRC staff requests that UIUC confirm that the scope of the topical report is limited to its future application to construct a research reactor at UIUC using the USNC design. Once confirmed, the NRC expects that this narrower scope would be reflected in revision of the topical report prior to NRC staff completing its draft safety evaluation.
