Cimarron Monthly Status Teleconference Notes March 15, 2023 Attendees:

NRC - HQ DEQ EPM Jim Smith Paul Davis Jeff Lux Ian Irvin Mike Broderick Christine Pineda Kelly Dixon Marla Morales Jon Reid Brittany Bolz Pam Dizikes Proposed Scope of Work and Budget for 2023 The scope of work and budget for 2023 was approved by both the NRC and the DEQ. EPM will send the approved scope of work and budget to those agencies listed in the Trust Agreement.

Review of Decommissioning Plan A letter accepting Facility Decommissioning Plan - Rev 3 for technical review, with a schedule for the review, issuance of RAIs, preparation of an Environmental Assessment and Safety Evaluation Report and eventual approval of the decommissioning plan, has been drafted and is in concurrence review. The letter may be issued by the end of March. The schedule will show the license amendment approving the decommissioning plan being issued by the end of 2024.

Amendment #3 to the 2011 Consent Decree and Environmental Settlement Agreement The NRC, DEQ, and EPM met with Rob Yalen via Microsoft TEAMS on February 24 to discuss a draft amendment to the 2011 Consent Decree and Environmental Settlement Agreement (the Agreement). EPM sent DOJ comments and suggested edits via email on March 3, 2023. It is our understanding that the Environmental Trust Agreement (Cimarron) - the Trust Agreement herein, which contains the same language as the Agreement, is subordinate to the Agreement and doesnt need to be revised to so the language matches that of the Agreement.

Letter Requesting Relief from NRC Fees (Exemption or Reduction)

NRC fees have represented approximately one fourth of the total decommissioning expenditures from the Federal and State Cost Accounts combined, and the DOJ asked if it would be possible to obtain a reduction or elimination of NRC fees to increase the possibility that the decommissioning criteria could be achieved with available funding. EPM is preparing a letter requesting exemption from NRC fees and will solicit review from legal counsel. The letter will be addressed to the Chief Financial Officer of the NRC.

The DEQ asked who within the NRC will act as Beneficiary for the NRC and advocate to the Commissioners and the Chief Financial Officer on behalf of NRC interests in the Trust. NRC stated this would probably be Jane Marshall, the Director of the Division of Decommissioning, Uranium Recovery, and Waste Programs.

The DEQ requested to see the letter before it is sent to the NRC. The NRC requested that Jane Marshall receive a copy of the letter sent to the Chief Financial Officer.

Cimarron Monthly Status Teleconference Notes March 15, 2023 Site Maintenance Issues Burns & McDonnell has contracted with Mills Construction for site maintenance. Repairs to the gates and fencing may be performed along with a mowing event to occur shortly. Burns &

McDonnell will contract with a licensed driller to abandon eight monitor wells; this will probably take place after the July groundwater sampling events.

Next Monthly Status Teleconference The next monthly project status teleconference is scheduled for 1:30 Central Time, 2:30 Eastern Time, on Wednesday, April 19th.
