Main Talking Points:
NRC and EDO FY2020 Priorities
- Transformation, innovation and creativity initiatives based on the futures assessment and JAM results, and supporting the associated office-level initiatives, are high on the EDO priority list.
- NMSS priorities include the Smarter Licensing and Oversight Initiatives and readiness for ATF/HALEU applications.
NMSS Reogranization (new Division of Fuel Management)
The NMSS reorganization will:
- Merge two technical divisions, the Division of Spent Fuel Management (DSFM) and the Division of Fuel Cycle Safety, Safeguards, and Environmental Review (FCSE).
- Relocate the Environmental Review Branch, now in FCSE, to a newly named Division of Rulemaking, Environmental, and Financial Support (REFS).
- Transfer environmental review staff currently in the NRR and NRO, and financial assessment staff in NRR, NRO, and NMSS' Division of Decommissioning, Uranium Recovery, and Waste Programs (DUWP) to the newly established cent ers of expertise (COEs) in the Rulemaking, Environmental Review, and Financial Support (REFS).
- The reorganization will lead to resource savings and anticipated efficiencies in workload distribution, collaboration, knowledge transfer, agility of critical skill sets, decision-making, and cross-office standardization.
Topics Provided by NE/:
Focus on ATF and Higher Enrichment/Higher Burnup
- NMSS is prepared and ready to support industry plans for the production and transportation of ATF batch loads for 2023 that are enriched to less than 5%.
- Assuming a high-quality and timely application is submitted to NMSS, staff has not identified any information need that would preclude an effective and efficient regulatory review to support ATF licensing actions with increased enrichment up to 8%
for enrichment facilities, fuel fabrication facilities, and transportation packages.
- Early engagement is critical. Vendors should have pre-application meetings with the NMSS staff to discuss key technical challenges vendors have identified.
- NRC sent a letter to NEI on August 25th, informing them of significant milestones related to licensing action for ATF and requesting that they assist in communicating this with members (ML19235A251).
Smarter Fuel Cycle Licensing and Oversight Programs
- On April 25th, staff issued two working group (WG) charters to conduct a holistic assessment of the Fuel Cycle licensing and inspection programs (ML19115A011, ML19074A139).
- The initiatives are aimed at considering ways which we can be more efficient and effective in accomplishing agency's goals while further integrating transformative ideas and risk-informed insights.
- A public meeting will be held in October to present draft recommendations to improve the licensing and inspection programs based on feedback received during the August 8th and September 12th public meetings.
Interactions with FCSE and RII managers and staff, e.g., CER meetings
- Cumulative Effects of Regulation is a publicly noticed full-day meeting to inform industry of NRC activities and reduce licensee burden by staggering the timing of requests for public comments. During the meetings, staff and/or industry present regulatory topics of generic interest. The most recent CER public meeting was held on September 25th. Discussion included topics provided in this one pager. The fuel cycle integrated schedule of regulatory activities supporting CER and supplement information can be found at ADAMS Accession No. ML19250G154 and ML19250G153.
FY19 Fee Decreases for Fuel Facilities
- The NRC will collect $24.5 million in annual fees from the fuel cycle facilities class.
- In comparison to FY 2018 {$27.7M), the fuel facilities budget resources decreased in FY 2019, primarily due to the anticipated completion of work associated with the Cyber Security Rulemaking and additional efficiencies to align resources with a smaller process workload.
- The estimated 10 CFR part 170 billings decreased in FY 2019 as a result of the expected termination of the MOX Fuel Fabrication facility construction authorization and license application withdrawal, and the expected completion of Honeywell's license renewal while plant operations are idle, offset by increase work for Westinghouse associated with an emergency preparedness exercise, its license renewal and increased work for conducting the Nuclear Fuel Services Force-on-Force.
Improved billing statements
- During FY 2018, NRC's Office of the Chief Financial Officer modified the billing statements sent to all NRC licensees. The invoices now contain more detailed information for each fee-billable cost activity code associated with that licensee over that billing period (e.g., see https://www.nrc.gov/about-n re/ regulatory/licensing/sample-invoice. pdf),
including the specific NRC staff that performed fee-billable work, the hourly rate associated with each staff member, the number of hours worked by each staff member, and the associated cost.
- The eBilling team conducted an eBilling briefing with an eBilling demonstration on July 23rd to NEI personnel and they invited NRC to at the NEI Regulatory Issues Working group on October 9, 2019. This event is attended by the Reactor community and they are interested in seeing eBilling.

- The eBilling team will be providing an eBilling demonstration and distributing the eBilling marketing brochure which explains and provides examples of eBilling and how to sign-up. NEI is fully aware and current on the eBilling project as they receive monthly updates from the eBilling team as part of our communications with the Licensees participating in eBilling development. Industry receives bi-monthly updates.
Opportunities:
Budget planning/formulation and early industry engagement (i.e. FY21)
- NRC follows 0MB directives on budget formulation and will make publicly available the FY 2021 budget in February of next year.
Transparency and prioritization of expenditure of annual fees
- As part of the FY 2019 Fee Rule process, to support increased transparency, the NRC presented in a public meeting the workload assumptions that comprise the FY 2019 budget, including work that is non-fee billable (i.e., part of the Part 171 annual fees). We continue to welcome industry input on the areas they see as priorities for t he industry.
Listserv Rollout for Publicly Available Fuel Cycle Correspondence beginning FY20
- FCSE and RII have coordinated the development and rollout of a Fuel Cycle Listserv. This method of licensee correspondence would achieve better utilization of staff resources and gain efficiencies both for the NRC and licensees.
