SUMMARY

OF THE MARCH 2, 2023, HYBRID OBSERVATION PUBLIC MEETING ON CARBON FREE POWER PROJECT EMERGENCY RESPONSE ORGANIZATION METHODOLOGY The U.S. Nuclear Regulatory Commission (NRC) staff held a hybrid observation public meeting with NuScale Power, LLC (NuScale) and Carbon Free Power Project, LLC (CFPP) on March 2, 2023. The purpose of this meeting was for NuScale to present the standard staffing methodology for the on-site emergency response organization with an assumed site boundary plume exposure emergency planning zone (EPZ). This NuScale standard staffing methodology is to be used by future US460 NuScale Power Plant licensees such as the CFPP.

The public meeting notice was posted on the NRC public website on January 31, 2023, and can be accessed on Agencywide Documents Access and Management System (ADAMS) Accession No. ML23031A124. NuScales non-proprietary presentation slides for this public meeting can be found under ML23051A032.

During the open portion of the presentation, NuScale stated that in order to develop its methodology, NuScale used the guidance provided in NSIR/DPR-ISG-01, Emergency Planning for Nuclear Power Plants, NEI 10-05, Assessment of On-shift Emergency Response Organization Staffing and Capabilities, and NUREG-0654/FEMA-REP-1, Revision 2, Table B-1, Preparation and Evaluation of Radiological Emergency Response Plans and Preparedness.

NuScale further stated that it plans to submit a licensing topical report to the NRC to obtain NRC approval of the methodology so that future NuScale US460 applicants and licensees can use to meet the regulatory requirements set forth in 10 CFR 50.47(b)(2), and 10 CFR 50.160(b)(1)(iii)(E), when issued.

Per NuScales methodology, the on-shift staff at NuScale US460 plant would be able to perform all required tasks in response to a declared emergency.

During the closed portion of the meeting, NuScale presented additional details regarding the assumptions for developing the methodology for a site boundary EPZ. For instance, NuScale discussed how the relevant Chapters and Sections in the NuScale standard design approval application, which is currently under NRC staffs acceptance review, would support the assumptions used to develop the ERO staffing for a site boundary EPZ. NuScale also described the areas where the methodology deviates from the existing guidance and NuScales reasons for doing so. Finally, NuScale provided an example of how the methodology would be followed in a hypothetical anticipated operational occurrence.

The NRC staff asked clarifying questions throughout the meeting to better understand the applicants assumptions for developing the methodology. The staff pointed out to NuScale the need for dose assessment as part of ERO staffing analysis. Additionally, the staff mentioned that using a shift-staffing analysis, similar to the approach in NEI 10-05, would not fully support developing ERO staffing plans. For instance, it would not address response timing or staffing numbers. The NRC staff also reminded NuScale/CFPP that SECY-22-0001, Final Rule:

Emergency Preparedness for Small Modular Reactors and Other New Technologies, has not yet been approved by the Commission, as such, the staff would not be able to review a topical report that referenced SECY-22-0001.

At the conclusion of the meeting, the NRC and NuScale staff agreed to coordinate a site visit to conduct different emergency response scenarios at NuScales control room and simulator facility in Corvallis, Oregon, and observe the ERO staffs response.
