SUMMARY
OF THE JANUARY 25, 2023, PARTIALLY CLOSED PRE-APPLICATION MEETING WITH NUSCALE POWER, LLC ON BEHALF OF CARBON FREE POWER PROJECT, LLC, TO DISCUSS FOUR-PHASE REVIEW STRATEGY AND ENGAGEMENT SCHEDULE Meeting Information:
The U.S. Nuclear Regulatory Commission (NRC) held an observation public meeting on January 25, 2023, to discuss, on behalf of Carbon Free Power Project (CFPP), LLC, NuScale Power, LLCs (NuScales) Four-phase review strategy and engagement schedule.
The public meeting notice dated October 20, 2022, was posted on the NRC public website, and can be found under ML22354A246. Information related to NuScale presentation can be found under ML23019A173 (Nonproprietary) and ML23019A181 (Proprietary). The enclosure provides a list of the meeting participants.
Meeting Summary:
The U.S. Nuclear Regulatory Commission (NRC) staff conducted the meeting in accordance with NRC Management Directive 3.5, Attendance at NRC Staff-Sponsored Meetings under ML21180A271). The main points of discussion during the meeting included:
NuScales discussed their Four-phase timeline and submission of the combined license application (COLA), projected in January 2024 with Acceptance Review in March 2024 and ultimately projected COLA approval in July 2026.
NuScale outlined their proposed pre-planned engagement, which includes a series of meetings for each of the following topics: cybersecurity, decommissioning funding, emergency planning,
environmental report, license structure, operator licensing, physical security/security plan, quality assurance program description, and volcanic hazards assessment. NuScale presented an approach to the phased readiness assessment which would include the following phases, ultimately covering all chapters of the Final Safety Analysis Report: Mechanical, Electrical/Instrumentation & Controls/Radiological, Programs, and Civil.
NuScale explained their intentions to identify, at the time of the readiness assessment, any deviations from the Standard Design Approval Application. NuScale went on to propose that this be an isolated topic with a dedicated forum in a future meeting. The NRC informed NuScale and CFPP that the staff would soon be issuing a letter clarifying the difference between referencing and incorporating by reference (IBR), and when each are required.
At the conclusion of the open portion of the public meeting, the staff opened the meeting to members of the public for questions and comments. There was one question from the public asking for clarification on the staffs guidance regarding referencing vs IBR and whether that guidance would be applicable to the applicant or staff. The NRC answered that the guidance would be applicable to the applicant. This satisfied the publics question.
Overall, this meeting met the objectives for the participants (NRC, NuScale, and CFPP) with regards to (1) NuScale/CFPP communicating the elements of the Four-phase review strategy and the timeline/ scope of pre-planned engagement activities, and (2) the NRC understanding/
clarifying the information that was provided.
