The Tennessee Department of Environment and Conservation (TDEC) Division of Remediation in Oak Ridge (DoR-OR) submits the following scoping comments to the NRC for consideration in preparation of the Environmental Impact Statement for the TRISO-X Special Nuclear Material License.

Comments

1. The EIS should present a review of any ongoing Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA) activities occurring or planned to occur within or around the site and discuss potential impacts of ongoing remediation.
2. If excavation of the site will be required, coordination with the Department of Energys (DOE) Excavation/Penetration Permit (EPP) program may be a requirement for site redevelopment and should be discussed in the EIS. The EPP program is in place for many sites in this area as a land use control for excavations at a depth greater than 2 ft below ground surface.

NEPA Review

3. Groundwater remediation is ongoing in the area and may include remediation at this site. As such, the EIS should include discussion of impacts to groundwater from TRISO-X activities, a discussion of baseline monitoring for current conditions, and a discussion of water management and treatment plans if necessary.
4. Groundwater is shallow in this area. If site excavation is planned that will encounter groundwater and may require dewatering, the EIS should include a discussion of plans to manage potentially contaminated groundwater, including associated permitting, and a discussion of coordination with the DOE EPP program as necessary.
