AVAILABILITY OF NUREG 2212 FOR PUBLIC COMMENT On January 18, 2023, the U.S. Nuclear Regulatory Commission staff conducted a public meeting to inform and discuss the issuance of NUREG-2212, Standard Review Plan for Applications for Title 10 of the Code of Federal Regulations (10 CFR), Part 70 Licenses for Possession and Use of Special Nuclear Materials of Critical Mass but not Subject to the Requirements in 10 CFR Part 70, Subpart H. A notice of availability for public comment on the document was issued on December 8, 2022.

Background

On December 8, 2022, the NRC published in the Federal Register a notice of availability of draft NUREG-2212, Standard Review Plan for Applications for Title 10 of the Code of Federal Regulations (10 CFR), Part 70 Licenses for Possession and Use of Special Nuclear Materials of Critical Mass but not Subject to the Requirements in 10 CFR Part 70, Subpart H, (87 FR 75295) for public comment. On January 18, 2023, the NRC staff conducted a public meeting to provide information on the availability of the draft NUREG-2212, its supporting Regulatory Analysis, and the process for submitting public comments.

Summary of discussions The NRC staff started the meeting by discussing the meetings category, agenda, purpose, and logistics. The NRC staff noted that the purpose of the meeting was to: 1) provide information on availability of the draft NUREG-2212 package for comments; 2) discuss the purpose of NUREG-2212; and 3) explain the process for submitting comments. This introduction was followed by opening remarks by the Director, Division of Fuel Management (DFM).

Following the opening remarks, the NRC staff presented an overview of the Standard Review Plan (SRP or NUREG) followed by an overview of the SRPs supporting Regulatory Analysis (RA). The NRC staff also provided links to the Federal Register Notice (FRN) and the Agencywide Documents Access and Management System (ADAMS) accession numbers of the documents. The FRN, published on December 8, 2022, provided notification that the comment period was due February 6, 2023. However, during the presentation, the NRC staff noted that a request to extend the comment period until March 31, 2023, had been received and was being considered. Participants at the meeting strongly supported the request.

2 During the discussion on the SRPs overview, the NRC staff explained that the NUREG would consolidate and establish clear, standardized guidance for NRC staff review of 10 CFR Part 70, Domestic Licensing of Special Nuclear Material, new license and renewal applications for possession and use of Special Nuclear Material in quantities exceeding the thresholds for critical mass quantities in 10 CFR 150.11, Critical mass, for the conduct of activities that, due to their nature, are not subject to the requirements in 10 CFR Part 70, Subpart H, Additional Requirements for Certain Licensees Authorized To Possess a Critical Mass of Special Nuclear Material. Examples of these activities include experiments using subcritical assemblies, instrument calibration, and instruction in radiation detection and measurement. NUREG-2212 is intended to enhance the effectiveness and efficiency of NRC staff reviews of these applications by streamlining the NRC staff review process for these applications. In addition, the NUREG will provide greater transparency and clarity for all stakeholders on the staffs review, and benefit licensees and applicants with the preparation of their respective licensing actions by providing acceptable methods or criteria to satisfy 10 CFR Part 70.

Additionally, the NRC staff discussed the format of the SRP and presented the ten technical areas addressed in the SRP. Following this discussion, the NRC staff proceeded to discuss the purpose of the RA, which discussed the need for the NUREG and the alternatives that the NRC staff considered (i.e., take no action or issue the document) during the development of the SRP.

The RA also assesses the benefits and costs of the alternatives to ensure the NRC staff selected the most cost-effective alternative.

Following the discussion on the RA, the NRC staff provided information on how to submit comments. There are two options for providing comments: through the federal rulemaking website (https://www.regulations.gov) or via mail to NRCs Office of Administration.

A questions and answers (Q & A) session followed. During this session, the NRC staff provided responses to several questions from industry representatives and the public. Given the time that remained until the adjournment of the meeting, the staff proceeded to discuss, in more specific detail, the guidance provided in the SRP. No additional questions were asked as part of this discussion. No regulatory decisions were made during the meeting.

Following the Q & A session, closing remarks were provided by Ms. Carrie Safford, DFM Deputy Director, which closed the main portion of the meeting. However, the NRC staff remained on the line to respond to any questions in case there were questions asked or calls made after the main portion of the meeting was over. No additional calls were received, or questions asked.

The meeting was adjourned at 2:30 PM.

Action Items There were no action items resulting from this meeting. However, the NRC staff will consider the request for extending the comment period on the SRP and RA from February 6, 2023, to March 31, 2023. If granted, the NRC staff will issue an FRN to inform stakeholders of the approval of this request.
