SUBJECT: DECEMBER 12, 2022, LETTER TO U.S. NUCLEAR REGULATORY

COMMISSION REGARDING REMAINING CONCERNS RELATED TO

ISSUANCE OF REGULATORY ISSUE SUMMARY 2022-02, OPERATIONAL

LEAKAGE

Dear Ms. Ginsberg:

I am responding to your December 12, 2022, letter requesting information on the U.S. Nuclear

Regulatory Commission (NRC) staffs issuance of Regulatory Issue Summary (RIS) 2022-02

Operational Leakage, dated November 3, 2022. This letter serves only to articulate the

viewpoint the NRC staff has previously expressed and does not constitute a change in its

position.

The NRC issued RIS 2022-02 along with the staffs response to public comments regarding the

draft RIS. This included a response to the Nuclear Energy Institute public comment dated

March 15, 2022. The RIS and responses to public comments state the basis for the NRC staffs

position on operational leakage. In addition, the Committee to Review Generic Requirements

(CRGR) reviewed the RIS and concluded that the staffs position in the RIS is not a backfit. The

CRGRs conclusion is publicly documented in a September 16, 2022, memorandum, which also

summarizes the three CRGR meetings related to RIS 2022-02 and provides references to the

materials presented. We have listed the documents described above in the enclosure, including

Agencywide Documents Access and Management System (ADAMS) Accession Numbers for

your convenience.
