Dear James Uhlemeyer:

We have reviewed the final revisions to the Kansas Radiological Health Regulations received by our office on November 8, 2022. These regulations were reviewed by comparison to the equivalent U.S. Nuclear Regulatory Commission (NRC) rules and the requirements of Regulation Amendment Tracking System Identification Numbers (RATS IDs) 2007-3, 2012-4, 2018-1, 2018-3, 2019-1, 2019-2, 2020-1, 2020-2, and 2020-3 as identified in the enclosed State Regulation Status (SRS) Data Sheet. We discussed our review of the regulations with you on February 9, 2023.

As a result of our review, we have four comments that have been identified in the enclosure.

Please note that we have limited our review to regulations required for compatibility and/or health and safety. We have determined that if these regulations are revised, incorporating our comments and without other significant change, they would meet the compatibility and health and safety categories established in the Office of Nuclear Material Safety and Safeguards (NMSS) Procedure SA-200, Compatibility Categories and Health and Safety Identification for NRC Regulations and Other Program Elements.

We request that when you revise your regulations to address our comments, a copy of the as published regulations be provided to us for review. As requested in NMSS Procedure SA-201, Review of State Regulatory Requirements, please highlight the location of any changes made by Kansas, in response to our comments, and provide a copy to Division of Materials Safety, Security, State, and Tribal Programs, NMSS. The SRS Data Sheet summarizes our knowledge of the status of other Kansas regulations, as indicated. Please let us know if you note any inaccuracies, or have any comments on the information contained in the SRS Data Sheet. Definition:

Low Specific Activity (LSA) material Kansas §28-35-135l(p)(1)(C) has and instead of or. Kansas needs to change the regulation to be consistent with §71.4 definition of Low Specific Activity (LSA) material.

Kansas §28-35-135l(p)(D)(2)(A) uses and instead of or. KS needs to change the regulation to be consistent with §71.4 definition of Low Specific Activity (LSA) material.

Kansas §28-35-135l(p)(D)(2)(B) has or at the end of the sentence which should be deleted to be consistent with §71.4 definition of Low Specific Activity (LSA) material.

Kansas §28-35-135l(p)(D)(3)(B) should have an and at the end of the sentence. Kansas needs to change the regulation to be consistent with §71.4 definition of Low Specific Activity (LSA) material.

Kansas needs to change the words as noted above in order to meet the Compatibility Category B designation assigned to 10 CFR 71.4, Definition of Low Specific Activity (LSA) material.

Kansas did not provide part 15 as part of the review so it is unclear what is contained in part 15. The review notes that 10 CFR Part 71 subpart H has been adopted by reference but there is no mention of 10 CFR Part 71 subparts A and G. Kansas needs to either adopt the applicable sections of 10 CFR 71 subparts A and G by reference, or submit equivalent regulations.

Kansas needs to make the above changes in order to meet the Compatibility Category B designation assigned to 10 CFR 71.17 and 71.21.

Terms and conditions of licenses Kansas states in subsection (h)(2) that the licensee should have procedures for using the instrumentation for the measurements noted. Kansas needs to insert that these procedures should meet the requirements of their equivalent regulations to 10 CFR 32.72(c).

Kansas needs to make the above change in order to meet the Compatibility Category B designation assigned to 10 CFR 30.34(j).
