Enclosure 3 U.S. Nuclear Regulatory Commission Summary of the January 26, 2023, Hybrid Observation Public Meeting with Department of Energy and NuScale Power, LLC to Discuss Carbon Free Power Projects Early Construction Plans at Idaho National Laboratory Meeting Summary The U.S. Nuclear Regulatory Commission (NRC) staff held a hybrid observation public meeting on January 26, 2023, with NuScale Power, LLC (NuScale), Department of Energy (DOE), and Carbon Free Power Project, LLC (CFPP) to discuss CFPPs plans for preconstruction and early construction activities at Idaho National Laboratory (INL). This public meeting was a continuation of NRC staffs September 13, 2022, meeting with NuScale and CFPP on the same topic. The staff made the presentation slides for the open portion of the meeting available to the public prior to the meeting on NRC public meeting web page and via the Agency-wide Document Access and Management System (ADAMS)1. This hybrid public meeting took place at the NRC headquarters in Rockville, Maryland.
Before CFPP started its presentation, Brian Smith from the NRC, Melissa Bates from DOE, John Volkoff from NuScale, and Scott Head from CFPP, provided opening remarks for their respective organizations. CFPP started the presentation by reiterating the importance of early construction phase to commence the commercial operation of the first nuclear module by the end of 2029. NuScale and CFPP representatives stated that they would need the NRC and DOE authorizations for early construction and preconstruction activities, respectively.
CFPP stated that its desired outcome from the meeting was to: (1) present its plan and schedule for conducting preconstruction and early construction to the NRC and DOE, and (2) receive feedback to ensure alignment on regulatory requirements and expectations. Specifically, CFPP stated that it was interested in obtaining clarity on key coordination points between DOE and NRC to complete the National Environmental Policy Act (NEPA)-required reviews as well as the duration of various reviews by DOE and NRC to facilitate CFPPs early construction and preconstruction schedules.
At the conclusion of the open portion of the public meeting, the staff opened the meeting to members of the public for questions and comments, however, there were no comments or questions from the public.
During the closed session, presenters from CFPP provided an update on their licensing strategy since the September 2022 public meeting with the NRC staff. The nature of the proprietary discussions included CFPPs early construction schedule, considerations of roles and responsibilities of DOE and NRC to review various CFPP submittals, and the scope of CFPP preconstruction activities at INL under the terms of the DOE Site Use Permit.
With respect to CFPPs plans for submitting its requests to obtain the required authorizations from the NRC, the NRC staff did not raise any concerns, however, the NRC staff informed CFPP that the requested NRC review schedules were shorter than historical NRC reviews for similar licensing actions. The staff also reminded CFPP of the importance of preparing quality submittals to minimize the need for requests for additional information or extended regulatory audits.

2 Regarding DOEs site use permit for conducting preconstruction activities, representatives from DOE clarified that DOE would have to review and approve certain preconstruction activities that would fall under DOEs site use permit terms, and that upon the conclusion of those efforts, they would coordinate with the NRC on hand-off of responsibilities.
At the conclusion of the closed portion of the meeting, the NRC and DOE staff requested CFPP to prepare a detailed and consolidated plan for all the preconstruction and early construction activities that CFPP plans to conduct and submit it to the NRC and DOE.
Additionally, the staff requested further interactions with CFPP, e.g., preforming a readiness assessment, as they continue to develop submittals for the NRCs review in order to allow the staff to better understand the scope of each submittal and provide CFPP with more accurate estimates for resources and the review period for each submittal.
