OF THE NOVEMBER 30, 2022, MEETING WITH X ENERGY LLC REGARDING THE "XE-100 PRINCIPAL DESIGN CRITERIA LICENSING TOPICAL REPORT (EPID NO. L-2022-TOP-0010)

On November 30, 2022, the U.S. Nuclear Regulatory Commission (NRC) staff held an open to the public meeting with representatives from X Energy LLC (X-energy). The purpose of the meeting was to discuss the NRC staffs preliminary questions that were developed as part of their review of X-energys "Xe-100 Principal Design Criteria Licensing Topical Report. X-energy submitted to the NRC staff the subject topical report (TR) for review on July 15, 2022. The set of preliminary questions were shared with X-energy via email on August 10, 2022 (Agencywide Documents Access and Management Systems (ADAMS) Accession No. ML23030B644).

The meeting was noticed on November 17, 2022, and the meeting notice is available at the ML22321A302.

During the meeting, the NRC staff and X-energy representatives discussed in detail each of the preliminary questions. During the discussion, the NRC staff noted the need for a revised TR that will include addressing the input provided in the preliminary questions.

X-energy representatives stated that they understood all the questions and noted that they will revise the TR to incorporate the input received. The input received included recommendations for clarification of terms use throughout the report and the use of required safety functions instead if safety-significant functions in some of the principal design criteria (PDCs).

One of the questions raised by X-energy representatives during the meeting was about the timeline for the NRC staff endorsement on NEI 2107 Technology Inclusive Guidance for Non-Light Water Reactor Safety Analysis Report: For Applicants Utilizing NEI 18-04 Methodology.

J. Proffitt The NRC staff explained that this effort is currently in review and the estimate of issuance will be early 2023.

Ian Jung, NRC staff and lead technical reviewer for the Xe-100 reactor design, noted that X-energy has followed Regulatory Guidance 1.232 Guidance for Developing Principal Design Criteria for Non-Light Water Reactors and respective and Modular High Temperature Gas Cooled reactors (M-HTGR) Advanced Reactor Design Criteria (ARDC) as the starting points and modified as needed to their technology design while trying to comply with the guidance.

This approach seems to be a solid basis for the NRC staff.

Jon Facemire, X-energy, said that by the time the construction permit is submitted, it will take into consideration all feedback received in this TR and other submittals.

At the end, X-energy representatives stated that they will meet internally to assess the path forward to provide the revised report and addressed all questions received. X-energy representatives noted that they anticipated that another meeting with the NRC staff will be needed before X-energy is ready to submit the revised TR and responses to the NRC preliminary questions. The NRC staff and X-energy took the action on scheduling the next meeting.

The meeting was conducted as an online meeting with attendees joining via Microsoft Teams.

There were members of the public in attendance, but they made no comments nor asked questions during the meeting. A list of meeting attendees is enclosed.

No regulatory decisions were made as a result of this meeting.
