ACCEPTANCE REVIEW OF SOUTHERN NUCLEAR OPERATING COMPANYS LICENSE AMENDMENT REQUEST FOR TECHNICAL SPECIFICATION SR 3.0.3 FOR NEVER-PERFORMED SURVEILLANCES (LAR-22-005) (EPID NO. L-2022-LLA-0187)

Dear Mr. Whitley:

By letter dated December 19, 2022 (Agencywide Documents Access and Management System (ADAMS) Accession No. ML22353A621), Southern Nuclear Operating Company (SNC) submitted a request for a license amendment to Combined License (COL) Numbers NPF-91 and NPF-92, for the Vogtle Electric Generating Plant Units 3 and 4, respectively. The requested amendment proposes changes to Technical Specifications (TS) Surveillance Requirement (SR) 3.0.3 and the associated TS Bases to allow application of SR 3.0.3 when a surveillance has not been previously performed and to clarify the application of SR 3.0.3.

These changes are consistent with NRC approved changes reflected in Technical Specification Task Force (TSTF) traveler TSTF-529, Clarify Use and Application Rules, for SR 3.0.3.

The purpose of this email is to provide the results of the U.S. Nuclear Regulatory Commission (NRC) staffs acceptance review of this request. The acceptance review was performed to determine if there is sufficient technical information in scope and depth to allow the staff to complete its detailed technical review. The acceptance review is also intended to identify

whether the application has any readily apparent information insufficiencies in its characterization of the regulatory requirements or the licensing basis of the plant.

Consistent with 10 CFR 50.90, an amendment to the license must fully describe the changes requested, and follow as far as applicable, the form prescribed for original applications. Section 52.79 of the 10 CFR addresses content of technical information required. This section stipulates that the submittal address the design and operating characteristics, unusual or novel design features, and principal safety considerations.

The NRC staff has reviewed your application and concluded that it does provide technical information in sufficient detail to enable the staff to complete its detailed technical review and make an independent assessment regarding the acceptability of the proposed amendment in terms of regulatory requirements and the protection of public health and safety and the environment. Given the lesser scope and depth of the acceptance review as compared to the detailed technical review, there may be instances in which issues that impact the staffs ability to complete the detailed technical review are identified despite completion of an adequate acceptance review. SNC will be advised of any further information needed to support the staffs detailed technical review by separate correspondence.

SNC has requested staff approval of this LAR no later than 12 months from acceptance. The staff will try to complete its review by 1/10/24 unless we agree to a different date at a later time due to circumstances beyond our control. The staff estimates that it may take 130 hours0.0015 days <br />0.0361 hours <br />2.149471e-4 weeks <br />4.9465e-5 months <br /> to complete this licensing action.
