SECTION 106 CONSULTATION OF THE NATIONAL HISTORIC PRESERVATION ACT FOR GLOBAL NUCLEAR FUELS - AMERICAS LICENSE AMENDMENT REQUEST (DOCKET NUMBER: 70-1113)

Dear Darin Waters:

The U.S. Nuclear Regulatory Commission (NRC) received, by letter dated June 24, 2022, an application from Global Nuclear Fuels-Americas (GNF-A) to amend Materials License Number SNM-1097 for its nuclear fuel fabrication facility located near Wilmington, North Carolina.

Currently under this license, GNF-A is authorized to receive and possess nuclear materials enriched up to 5 weight (wt) percent uranium 235 (U-235) and to fabricate and assemble nuclear fuel components under the provision of title 10 of the Code of Federal Regulations (10 CFR) part 70, Domestic Licensing of Special Nuclear Material. If this amendment is approved, GNF-A will be authorization to receive and possess nuclear materials enriched up to 8 wt percent U-235, also referred to as low enriched uranium plus, and to fabricate and assemble nuclear fuel components under the provision of 10 CFR part 70. GNF-A is not requesting any activities that require groundbreaking activities under this amendment. Material license SNM-1097 was initially issued to GNF-A in 1969 and renewed in 2009 for a 40-year period.

With respect to the license renewal environmental assessment (EA), dated May 2009 Agencywide Documents Access and Management System (ADAMS) ML091180239, the NRC staff determined that the proposed action to renew the license did not have the potential to cause effects on historic properties if present. In a letter from the North Carolina State Historic Preservation Offices (NC SHPOs) office, dated January 31, 2008, the NC SHPO replied, stating, At its current size and location, the GNF-A facility does not affect any historic buildings or archaeological resources eligible for inclusion on the National Register of Historic Places, there are, within the 1664-acre tract of land on which the GNF-A facility is situated, six identified archaeological sites. GNF-A does not anticipate expansion of the existing facility footprint for this amendment request.

As established in 10 CFR part 51, the NRC regulation that implements the National Environmental Policy Act of 1969, as amended (NEPA), the NRC staff is preparing an EA for the proposed action. The purpose of the EA is to assess potential environmental impacts that may significantly affect the human environment. In accordance with 36 CFR §800.8 Coordination with the National Environmental Policy Act, the NRC staff is coordinating compliance of the section 106 of the National Historic Preservation Act of 1966, as amended, with its NEPA review process. The EA will include an analysis of potential impacts to historic and cultural resources.

D. Waters 2 In support of the environmental review, the NRC is requesting your concurrence on NRCs determination that the proposed license renewal does not have the potential to cause effects to historic properties, assuming they were present.
