Use of Decommissioning Funds for Major Radioactive Component Disposal -
EnergySo/u/ions has filed a Petition for Rulemaking requesting a change to the definition of decommissioning to allow operating plants to have access to excess funds in the decommissioning trust fund to dispose of major radioactive components that are typically stored on site for decades until the plant is permanently shutdown. The public comments
received were supportive and NEI has changed their position from neutral to supportive based on nuclear industry feedback. This petition will aid operating plants in continuing to be competitive in the market place. We would like to see a decision on this petition in 2022.
Risk Informed Decision Making - Risk informed decision making is needed in more areas in NMSS and particularly in license termination. It would be beneficial to provide further guidance in areas not covered by MARSSIM such as underground structures, discrete radioactive particles and the use of the basement fill model. The July 2021 workshop is a good start and additional NRC workshops are planned in 2022 for these topics. The draft NEI guidance document includes industry experience and incorporate lessons learned and is undergoing internal review. The document further de*fines scope and content of the license termination plan and the final status survey reports to reach industry and NRC consensus on improving the back end of the license termination process.
GTCC Rulemaking - We support GTCC rulemaking as a means to dispose of this form of low level waste. Now tied with Part 61 rulemaking that is in its eleventh year. This should be moved up in priority.
Decommissioning Rulemaking - Plants relying on state support to continue operation are more likely to permanently shut down in the future. This rulemaking would improve efficiency and save resources for both the NRC and the industry as plants transition from operations to permanent shutdown and move the spent fuel to the ISFSI.
