ACCEPTANCE OF WESTINGHOUSE REQUEST FOR REMOVAL OF FLYWHEEL AND CORRECTIONS - CAC/EPID L-2022-LLA-0154 Date: Thursday, November 3, 2022 12:46:00 PM

Dear Patrick Donnelly:

The U.S. Nuclear Regulatory Commission (NRC) staff has received your submittal dated October 21, 2022 (Agencywide Documents Access and Management System (ADAMS) Number ML22294A178),

requesting to amend license SNM-1107 to remove a depleted uranium flywheel and submission of license application page changes for updates and corrections.

We have completed our acceptance review of your submittal and have identified no administrative omissions or deficiencies that would prevent us from proceeding with a detailed review. Your submittal has been assigned Cost Activity Code (CAC)/Enterprise Project Identification Number (EPID) L-2022-LLA-0154. Please reference this number and Docket Number [docket number] in any future correspondence associated with this request.

Please note that the NRC staffs technical review of your submittal may identify issues that could require that you provide additional information. Based on our preliminary evaluation and projection of current review schedules, we anticipate completing our formal review by March 2023. This schedule includes the issuance, if needed, of a request for additional information (RAI) by November 30, 2022, and receiving your response to the RAI 30 days after its issuance. Please note that these dates could change depending on the findings of our technical review, urgent assignments, or other factors, such as whether your responses to the RAI are or not adequate. Within 30 days after completion of the NRC staff review of your application/submittal, a notice will be published in the Federal Register to inform the NRC staffs decision regarding your submittal. The NRC staff estimates that completing the review of your submittal will require approximately 20 staff hours which corresponds to about $5,800.00 [provide cost per hour that applies during the Fiscal Year - $

290.00/hr]. We will promptly communicate significant schedule and/or cost changes, if any.

In accordance with Title 10 of the Code of Federal Regulations, Section 2.390 of the NRCs Agency Rules of Practice and Procedure, a copy of this letter will be available electronically for public inspection in the NRC Public Document Room or from the Publicly Available Records component of the NRCs ADAMS.
