RE: RE: [EXTERNAL] RE: Discussion of La Crosse Class 1 Survey Unit Review - WTB Specifics and Other Open Items Date: Wednesday, September 7, 2022 1:01:43 PM Hi Gerry!

Apologies for the delayed response on thiscrazy couple of week and I am technically on leave this week to celebrate Torstens first birthday (WHAT?!?!?). But I did want to follow up to see if maybe you and I (and Sarah and Tom if needed?) would be able to have a quick chat sometime next week on any of the items that are still lingering for La Crosse and discuss what the best path forward may be to close some of them out before we convene another meeting of the whole gang.

Specifically I think there are a couple other places where ES making a definitive statement on the record (regarding the typo we already discussed, the assumption on reactor building shine affecting background in CDR, and the bounding analysis for the elevated reading in the RPGPA sump GeoProbe samples) when you send in the July responses officially may scratch the itch to ensure we are relying on the right kind of documented information to make our conclusions, and not just basing everything on our understanding from these calls.

Im hoping that will give us a better idea the path to closure on all of these issues without the need for as much back-and-forth in the future. Im still talking through these items with both my management and the technical team so some items may shake out over next week that I can update you on as well, but again I thought it might be best to meet informally before we set up another full bore meeting.

Let me know what you think and what your availability may look like for next week and hopefully we can get something set up! I am in and out a bunch for other meetings and commitments but Im sure we can find a matching opening somewhere :-) I hope all is well in the meantime and that you are getting excited for your trip. If I remember right, next week is your last one in the office before you depart so hopefully we can make sure you leave on a good note and can leave all of this far far behind during your travels!

Good afternoon gentlemen!

I had a chance to powwow with our legal folks about how to best document/certify the erroneous result for sample L1-010-101-FJ-GS-C16-SB and they offered the following:

1. The cleanest fix would be to remeasure the sample and simply update the associated release record (or wherever the 154 pCi/g of Cs-137 is listed). Then we would not even need to include any of this narrative in the SE and would have a certain answer related to this survey result.
2. Absent that, if you would be willing to send in the narrative and figure you provided via BOX (attached) under an ES cover letter that we could add to the docket and reference in relation to this topic in the associated SE writeup that would be acceptable as well. The cover letter could probably just say something along the lines of As a result of discussions on June 7, July 7, and August 24,2022, with the NRC staff on the ongoing LACBWR FSSR review, an error was identified in the release record for the Waste Treatment Building (WTB) Excavation (Survey Unit L1-010-101C related to judgmental sample L1-010-101-FJ-GS-C16-SB. The sample result shows a concentration of 154 pCi/g of Cesium-137, which was determined to be a typographical error based on EnergySolutionss determination that[extra, useful information ]

So I wanted to pass all of that along and at least ask the question regarding the ease (or burden!)

and timeframe for potentially remeasuring the sample from the warehouse in Memphis. It is up to you which path makes the most sense, and I think we can get to resolution on either one, so let me know what makes sense from your side and we can proceed accordingly.

Separately I am working with the team to start and keep a better listing of the final review items we are still working on in the hope that we can share this proactively (and maybe even keep it as a live document via BOX) and see how close we are to checking everything off the list. Regardless we are still planning to have the SE into concurrence next month if at all possible, which will give us a reasonable amount of time to work everything through legal review and concurrence.

THANK YOU all again as always, have a great weekend, and I will talk to you soon!

Where: Microsoft Teams Meeting Hi all! I am totally taking a stab in the dark **without** checking with anyone first that this date/time might work for our next discussion on the La Crosse Class 1 survey units. If not that is totally fineI can coordinate with Gerry and Sarah to find a better match on the calendars, just let me know!

This meeting will hopefully be to discuss the remaining open items from last weeks call as well as an additional issue raised this week (see attached email) that may boil down to a misunderstanding of some of the discussions that have already occurred, but we would like to figure it out regardless!

Please forward on to whomever necessary and give me a shout if you need anything between now and then!
