Title:
Meeting between the U.S. NRC and Tennessee Valley Authority to Discuss Topics Associated with Pre-Application on Matters Related to the Development of a Construction Permit Application for the Clinch River Nuclear Site (Docket No. 99902056)

The purpose of this meeting was to discuss topics associated with Tennessee Valley Authority's (TVAs) preparation of a construction permit application for the Clinch River Nuclear Site that may require clarification and/or technical interactions. Specific topics discussed were associated with the following three subject areas related to the submittal of the Preliminary Safety Analysis Report (PSAR) and Environmental Report (ER) for the Clinch River Nuclear (CRN) Site:
Draft Topical Report on Quality Assurance Program Description (QAPD) for TVA New Nuclear Program Lifespan of Environmental Data (Fisheries, Meteorological, Water Quality, etc.)
New and Significant Process Prior to the public meeting, topical areas for discussion were provided in the Related Documents section of the public meeting notice available as Agencywide Document Access and Management System (ADAMS) accession number ML22230C938. Another topic related to meteorological data for both the PSAR and the ER was identified for potential future public discussions. NRC Project Managers were present to give feedback to TVA on the above topics.
Summary of Meeting Based on the detailed topics for discussion made available in advance by NRC staff (ML22230C938), TVA staff provided clarification on the QAPD on information evaluated using the American National Standards Institute/American Society of Mechanical Engineers (ANSI/ASME) NQA-1, Quality Assurance Program Requirements for Nuclear Power Plants, 2015, to the NRC staff. Specifically, the TVA staff provided clarifications on the exceptions taken to NQA-1 in (1) Section 2.7, related to certification expiration on qualification records, (2)
Section 4.1 related to review of technical and QA program requirements prior to award of a contract, and (3) Section 7.2 related to use of Electric Power Research Institute (EPRI)
Technical Report (TR) 3002020796, Remote Assessment Techniques Planning and Conducting Audits and Surveys Using Remote Techniques During Exigent Conditions.
Additional QAPD clarifications were provided to NRC for the Interface with Reporting Program as described in Section 15.1 and 16.1 of the QAPD along with a document formatting question.
TVAs QAPD Topical Report was submitted to NRC on August 25, 2022 and is available in ADAMS as accession number ML22238A101.
TVA provided clarification on the types of environmental data, monitoring activities and information data that will be collected and evaluated for the Construction Permit Environmental Report to assess the type and extent of environmental impacts that may arise from new information based on previous evaluations made for the Early Site Permit (ESP) studies (see detailed slides identified below).
The TVA provided an overview of the process to evaluate new and significant information with a four-step procedure. The TVA will review a variety of sources including the Programmatic Environmental Impact Statement recently developed for the CRN Site to determine if information can be found that is both new and significant that would result in substantial changes to the determinations made for the CRN Site ESP application review.
NRC staff discussed that the environmental information lifespan was linked to new and significant processes since the future application would reference the 2019 ESP. The staff shared the guidance documents that define new and significant (2007 FRN for the Part 52 Rule, 2007 updates to the NUREG-1555, Environmental Standard Review Plan, Staff Guidance on supplementing a Draft or Final Environmental Impact Statement (ML13199A170), and in the 2013 Revisions to the License Renewal Generic Environmental Impact Statement (NUREG-1437), There was a discussion on potentially auditing the new and significant process that is being developed by TVA before the application is submitted. Staff noted that TVAs new and significant evaluation process should be auditable by NRC staff and that the process will be evaluated under NRCs pre-application audit plan which is currently under development which is stated in NUREG-1555 draft revisions from 2007. The NRC regulations at 50.51(c)(1)(iv) states that:
A description of the process used to identify new and significant information regarding the NRC's conclusions in the early site permit environmental impact statement. The process must use a reasonable methodology for identifying such new and significant information.
From a member of the public, the NRC staff addressed questions and comments related to the as to the QAPD report, readiness assessment process, transparency in the NRCs assessment process and purpose of the NRCs readiness assessment evaluation.
