QUALITY ASSURANCE PROGRAM APPROVAL FOR RADIOACTIVE MATERIAL PACKAGES NO. 0003, REVISION 31

Dear Gary Peters:

Enclosed is the revised Form 311, Quality Assurance Program (QAP) Approval for Radioactive Material Packages Approval No. 0003, Revision 31, in response to your request for approval of Framatome Inc.s Title 10 of the Code of Federal Regulations (10 CFR), Section # 71, Subpart H Quality Assurance Program Description for Packaging and Transportation of Radioactive Materials for US Fuel, FS1-0011462, Revision 8.0, dated June 10, 2022, (Agencywide Documents Access and Management System

{ADAMS} Accession No. ML22166A343). A copy of the referenced QAP was attached to this letter.

Framatome Inc.s initial request for approval of Revision 6.0 of its QAP (ADAMS Accession No ML20178A454) was received in a letter dated June 22, 2020, (ADAMS Accession No. ML20178A453). In this letter, Revision 6.0 was erroneously identified by Framatome Inc. as a change that did not reduce commitments. This revision, however, incorporated language that allowed for a 25% extension (9 months) between external audits during times of exigent conditions. This change effectively extended the allowable time interval between supplier audits and, therefore, was a reduction in commitments to the U.S. Nuclear Regulatory Commission (NRC). This discrepancy was identified by NRC staff and was communicated to Framatome Inc.s personnel in subsequent discussions.

In response to the NRC, Framatome submitted Revision 7.0 of their QAP (ADAMS Accession No. ML21085A684) for NRC approval in a letter dated March 17, 2020 (ADAMS Accession No. ML21085A683). Upon receipt of the QAP, NRC staff noted administrative discrepancies in this submittal. Specifically:

1. The date on the letter requesting approval was incorrect. The correct date should have been March 17, 2021 vice March 17, 2020.
2. The date for Revision 7.0 was incorrect in the submitted QAP. It was listed as 3/1/2020 vice 3/1/2021.

Upon identification, NRC staff informed Framatome Inc.s personnel of these discrepancies and requested that they be corrected.

In a letter dated June 10, 2022 (ADAMS Accession No. ML22166A343) 10 CFR 71, Subpart H Quality Assurance Program Description for Packaging and Transportation of Radioactive Materials for US Fuel FS1-0011462, Revision 8.0 that corrected the error in Revision 7.0 and incorporated additional administrative changes.

The enclosed Form 311 documents the staff approval of your revised QAP to satisfy the requirements of Title 10 of the Code of Federal Regulations (10 CFR) 71.17(b) and 71.101(c).

Termination of your materials license does not cause this approval to be automatically terminated. If you wish to amend this approval and have determined it reduces commitments or would like to terminate this approval, please request it in writing.

This letter also serves as a reminder that if Framatome is using or planning to use an NRC-approved package, Framatome must be registered for use of that package with the NRC.

Registration for use of NRC-approved packages should be made pursuant to 10 CFR 71.17(c)(3).

Also, as a reminder, it is important to include the correct docket number when submitting correspondence to the NRC. For correspondence relating to Framatome Inc.s 10 CFR 71 activities, the applicable docket number is 71-0003. Annotating the correct docket number ensures that documents are routed to the responsible NRC personnel in a timely manner.
