GE-HITACHI NUCLEAR ENERGY AMERICAS LLCVALLECITOS NUCLEAR CENTER, CLOSURE OF CONFIRMATORY ACTION LETTER NO. NRR-03-016 ON THE SITE-SPECIFIC COMPENSATORY MEASURES IMPLEMENTATION PLAN

Dear Mr. Martinez:

The purpose of this letter is to inform you that the U.S. Nuclear Regulatory Commission (NRC) has closed Confirmatory Action Letter (CAL) No. NRR-03-016. The NRC issued CAL No. NRR-03-016 on December 5, 2003 (Agencywide Documents Access and Management System (ADAMS) Accession No. ML032721552). This CAL formalized commitments to implement site-specific compensatory measures related to security and safeguards.

By letter dated April 4, 2022 (ML22132A272cover letter only), the NRC received a revised physical security plan (PSP) for the GE-Hitachi Nuclear Energy Americas LLC (GEH) research reactor, in support of license renewal for Facility Operating License No. R-33. In response to this letter, the NRC staff reviewed the GEH PSP and found it to be in compliance with the applicable regulations contained in Title 10 of the Code of Federal Regulations (10 CFR)

Part 73, Physical Protection of Plants and Materials, as stated in the NRC letter dated May 26, 2022 (ML22144A196). In addition, the NRC staff found that the GEH PSP incorporates the site-specific compensatory measures committed to in CAL No. NRR-03-016. Therefore, the NRC considers CAL No. NRR-03-016 closed.

Under 10 CFR 2.390, Public inspections, exemptions, requests for withholding, the NRC will make a copy of this letter available electronically for public inspection in the NRC Public Document Room located at NRC Headquarters in Rockville, Maryland. The public can also access this letter in the NRCs document system, ADAMS, on the NRCs website at https://www.nrc.gov/reading-rm/adams.html.
