NRC STAFFS RESPONSE TO EXTENSION REQUEST The NRC staff (Staff) hereby responds to Erwin Citizens Awareness Network, Inc.s (ECAN) July 26, 2022, request to extend the deadline for filing a request for hearing and petition for leave to intervene regarding a Nuclear Fuel Services, Inc. (NFS) license amendment application. After reviewing ECANs request, the Staff has determined that, given the contents of the application, it is appropriate to issue a new notice of hearing for this proceeding to provide potential petitioners with procedures to gain access to relevant records that contain Sensitive Unclassified Non-Safeguards Information (SUNSI). The reissued notice of hearing will detail how to request access to SUNSI, the criteria the Staff will use to evaluate an access request, and the timing milestone for informing a requester of an access determination. The deadline for requesting access to SUNSI will be provided in the Federal Register notice (FRN) renoticing this application and is 10 days after publication of the FRN; this is a separate deadline from the filing date to submit a request for hearing and petition for leave to intervene.

Potential petitioners will have 60 days after publication of the FRN to submit a request for hearing and a petition for leave to intervene.
