RESPONDENTS STATUS REPORT
By order dated April 21, 2021, the Court consolidated each of these petitions
for review and ordered that Respondent s file status reports concerning the
proceedings on April 29, 2021, and at 90-day in tervals thereafter. Pursuant to that
order, Respondents U.S. Nuclear Regulat ory Commission and the United States
report that the application filed by Holtec International for a license to construct
and operate a consolidated interim spen t nuclear fuel storage facility in Lea
County, New Mexico, remains under consideration by th e agency. The agency
published a Final Environmental Impact St atement regarding the facility on July
13, 2022, and a licensing decision is expected in 2023.
