Dear Sir or Madam:

As we discussed during the December 14, 2021 and June 22, 2022 public meetings (Reference 3), Global Nuclear Fuel -Americas (GNF-A) is requesting prior written approval for foreign obligation reassignments on similar and fungible uranium inventory specified in the current GNF-A special nuclear material (SNM) license (Reference 1).

The Attachments to this letter provide additional information regarding this request.

Background

GNF-A is the holder of NRC License SNM-1097 for a fuel manufact uring facility at the Wilmington, NC site.

Guidance document NUREG/BR-0006 Instructions for Completing Nu clear Material Transaction Reports, Revision 9, Appendix F identifies the prin ciples and instructions to track and report foreign obligated nuclear materials and nuclear mate rial produced from foreign obligated material from foreign suppliers.

As discussed during NRC public meetings on December 14, 2021 an d June 22, 2022, GNF-A is requesting a one-time prior written approval to exchange foreig n obligations between similar materials (i.e., material type (MT) 10, 20 E1, 20 E2 & 81) repo rted in inventory for reporting identification symbol (RIS) codes with other domestic RIS codes consistent with GNF-As commercial practices and needs. The type, quantity and forms of licensed material and activities are specified in the current GNF-A NRC license SNM-1097.

Obligation Exchange Details

Below are details for the request.

1) Proposed date to exchange obligations - through May 19, 2049 (current SNM-1097 license expiration date)
2) Quantities of materials to be exchanged - up to 50,000 kg U-235 per year.
3) Material types and associated obligations to be exchanged - Material types include 10, 20 E1, 20 E2, and 81. Attachment 2 provides a current list of potentially affected foreign obligation codes. Note that this list is subject to change.
4) Chemical and physical form of the material to be exchanged - Any chemical or physical form of uranium or uranium compounds.
5) Purpose for conducting the exchanges - continuous fuel manuf acturing activities such as conversion, blending, fabrication of nuclear reactor fuel (p owder, pellets, or assemblies) and material or waste recovery.
6) RIS code involved in the change - YLJ

GNF-A proposes a new Safety License Condition SG-1.4 be issued to reflect the authorization as follows:

SG-1-4 Notwithstanding the guidance described in NUREG/BR-0006, the licensee is authorized to exchange foreign obligations be tween similar materials as needed for routine licensed activities.
