UNITED STATES OF AMERICA NUCLEAR REGULATORY COMMISSION In the Matter of NUCLEAR FUEL SERVICES, INC. Docket No. 70-143-LA (Application to amend special nuclear material License, Erwin, Tennessee)

ORDER On June 10, 2022, Erwin Citizens Awareness Network, Inc. (ECAN) requested a three-month extension to the June 27, 2022, deadline for filing hearing requests and petitions for leave to intervene in the matter of a Nuclear Fuel Services, Inc. license amendment application, citing, as the basis for the request, hardships related to the ongoing COVID-19 pandemic and lack of broadband Internet access.1 Pursuant to my authority under 10 C.F.R. § 2.346(b) and after consideration of ECANs request, I am granting ECAN a 30-day extension to the filing deadline in this matter. Accordingly, ECANs hearing requests and petition to intervene in this matter will be deemed timely if filed on or before July 27, 2022.

IT IS SO ORDERED.

Dear James Downs,

On behalf of Erwin Citizens Awareness Network (ECAN), I am formally requesting an extension of the June 27, 2022 deadline to submit a request for a hearing or petition for leave to intervene in the matter of Nuclear Fuel Services' License Amendment Application, Docket ID NRC-2022-0097.

The ongoing COVID pandemic has made it unsafe for the leaders and members of ECAN to meet in person. And, for many in our community, the lack of broadband internet access in rural northeast Tennessee is an obstacle to meeting via online platforms.

Therefore, ECAN requests that the deadline be extended for three (3) months to October 27, 2022.

Between now and then, it is likely that supplies of PAXLOVID will be more readily available in our area, reducing our risk of serious COVID symptoms should transmission occur during in-person meetings.

Also, by then, the current rise in COVID cases will have hopefully subsided allowing ECAN members to collaborate in person again and prepare a proper hearing request.
