U.S. NUCLEAR REGULATORY COMMISSION VERIFICATION LETTER FOR GE-HITACHI LICENSING TOPICAL REPORT NEDO-33914-A, REVISION 2, BWRX-300 ADVANCED CIVIL CONSTRUCTION AND DESIGN APPROACH

Dear Ms. Catts:

By letter dated June 17, 2022, GE-Hitachi Nuclear Energy Americas, LLC (GEH), submitted the approved (-A Revision 2) version of Licensing Topical Report (LTR) NEDO-33914-A, BWRX-300 Advanced Civil Construction and Design Approach, Revision 2 (Agencywide Documents Access and Management System (ADAMS) Accession No. ML22168A010), to the U.S. Nuclear Regulatory Commission (NRC) staff for final verification in support of a future licensing application for the GEH small modular reactor under Title 10 of the Code of Federal Regulations (10 CFR) Part 50, Domestic Licensing of Production and Utilization Facilities, or Part 52, Licenses, Certifications, and Approvals for Nuclear Power Plants.

GEH submitted the -A version of the subject LTR in accordance with the NRC request to publish an approved version, as detailed in the staff final safety evaluation transmittal letter dated April 27, 2022 (ML22103A126).

The NRC staff has verified that the submitted -A, Revision 2, version is acceptable and is approved for referencing in future licensing applications for the BWRX-300 to the extent specified and under the defined limitations of the LTR process.

If the NRCs criteria or regulations change so that its conclusion in this letter (that the LTR is acceptable) is invalidated, GEH and/or an applicant referencing the LTR will be expected to revise and resubmit its respective documentation or submit justification for the continued applicability of the LTR without revision of the respective documentation.
